Statement on Supreme Court’s Denial of Schiavo Appeal

WASHINGTON – House Majority Leader Tom DeLay (R-Texas) today criticized the U.S. Supreme Court’s refusal to explain its decision to deny an appeal that would allow Terri Schiavo to continue receiving food and water. The appeal, which was filed by the general counsel for the U.S. House of Representatives, called for the Supreme Court to modify the order placed by Florida Judge George Greer to remove Schiavo’s feeding tube in order for her to appear as a witness at a House Government Reform Committee hearing on March 25, 2005.

“While I respectfully disagree with the Supreme Court’s decision, the justices’ refusal to offer any explanation or guidance – knowing that Congress is working around the clock to save the life of a defenseless dying woman – is a moral and legal tragedy.

“The Supreme Court owes it to Terri Schiavo and her family – and, frankly, to the dignity of human life – to explain their decision so that Congress can properly focus its continuing work to replace Mrs. Schiavo’s feeding tube.

“When this tragic episode is resolved, the Supreme Court will have some serious questions to answer about its silence and arbitrary interpretation of federalism, but those questions will have to wait for now.

“In the meantime, the fight is not over. We will continue to work with the Senate to negotiate a legislative solution, and we won’t rest until we find one. Mrs. Schiavo’s struggle to live, our fight to save her, and the American people’s prayers will all continue.”

2. I think the SC had already
been asked to look at the case, maybe twice, and refused. They said this time was different because they got some new doctor that said she was in a state of minimal consciousness not a persistant vegetative state. The Supemes still didn't buy the argument.

since it would probably involve a lengthy discussion about how the legislation was unconstitutional, that it is inappropriate and against the framers intention for one branch to attempt to influence the another, not to mention that taking the matter from the state court like they did is fundamentally contrary to the state's right principals the republican party used to support....

....and on the moral front, the court could opine that they are in fact supporting the very sanctity of marriage that delay and others espouse (although don't always actually practice) by recognizing the rights of her husband to be her guardian.

but this guy is incredibly powerful - and one has to look beyond his surface actions to keep an eye on what he is doing. He wants a permanent, one party state - and does not believe in laws - just power. Worse, is how desperate he is right now. Ugly, ugly. But one always has to watch a snake very, very closely - esp when their action, on the surface, looks futile.

11. Remember - all De Lay has to do to keep power
is demonstrate to his corporate backers that he is "safe" - eg will keep getting elected. Showing the power he has by forcing this type of legislation is imp because he uses that to demonstrate that he won't be taken down by ethics charges. While the corp backers do not give a damn about this case - they want access to DeLay and to that much power (and ability to write themselves and their businesses into law). Look behind the curtain for the motives on this one.

Delay is censuring SCALIA now! Ummmm, mistake.
Scalia is not going to like this at all. He is very conservative yes but is very literal in his interpretation of the constitution. He won't like Delay's posturing. It will be a mistake to alienate him. Probably too late.

I despise Tom Delay. I cannot wait for him to go to jail or be stripped of his powers.

21. Tom Delay is right about one thing...

He claims to find "parallels" between Schiavo's case and his own as noted in this article:

The big parallel is that I think both he and Terry have about the same level of constructive brain activity now... The difference being is that his lack of such is by choice and hers isn't! Jerk!
