so what will Scalia say about Schiavo during confirmation hearings
If Chimpy tries to make him Chief Justice. How can the religious right allow Scalia to be elevated to the court when he didn't stand up for Terri...

My bet is that the Judiciary Repubs don't touch this question with a ten foot pole if Scalia gets the nomination

The repugs would stay away from the Terri S. issue if they wanted confirmation of Scalia as Chief.

On a different note, though, can't you imagine what Scalia and Thomas (and maybe Rhenquist) are up to right now? Can't you just picture them running around grabbing the rest of the Justices by the collar and screaming into their faces, "We have to intervene. We have to save Terri!"?

I imagine Thomas is threatening to hold his breath until he passes out.

4. scalia often dissents
It takes four votes for the Supreme Court to decide to hear a case. Ordinarily, when a case is turned down without being heard (which is what happened to the Schiavo claim), the court won't indicate what the "vote" was. However, on occasion a Justice will issue a dissent from the denial. Scalia has done this on a number of occasions, including in a case involving the teaching of evolution/creationism and a case involving affirmative action.

While he might weasel around and claim that he disagreed with the Supreme Court decision not to hear the Schiavo case, it would be fair to ask why he didn't indicate his dissent as he has in other cases.
