Uphold the constitution? Congress, Bush broke it...
They knowingly passed a bill, and Bush knowingly signed a bill that was unconstitutional. They broke the oath.

3. Not exactly right. Courts are enforcing the statute as written.
The rulings presume, for now, the constitutionality of the new law.

However, the new law was oversold to the fundies as a sure fire way to keep the feeding tube in. The courts are reading the law as it was actually written and denying the parents' motions. For that, the judges will be labeled activist and worse.
