Well, Oregon paper says they did not sell photo to USA Next,

Well, Oregon paper says they did not sell photo to USA Next,
That is not the policy of the paper, and they never seel any photos without the express authorization of the people in the hoto. CNN contacted USA Next, and they said they didn't buy the photo, but they think their web master did. They then contacted the web master, and they were told....."Oops! We Screwed up!"

Well, isn't that just cute!

This was announced on Inside Politics today.
Hope these idiots have to pay the people in the photo they used WITHOUT authorization, and pay BIG TIME!

Copied ‘kissing’ photo ignites furor

A photograph lifted without permission from the Portland Tribune’s Web site has landed smack in the middle of an angry national debate involving patriotism, Social Security and gay marriage.
The photo, showing two Portland men just before their marriage last March, was used in an Internet advertisement for USA Next, a group attacking AARP for opposing President Bush’s plan to change Social Security. The ad ran from 6 p.m. Feb. 15 to 10 a.m. Feb. 21 on www.spectator.org, the Web site for the conservative magazine The American Spectator.
The photo has become fodder for both sides in the political culture wars.
On one hand, USA Next used the photo as part of its campaign to alienate American Association of Retired Persons members and others by saying the group supports gay marriage. On the other hand, the men in the photo, Rick Raymen and Steven Hansen of Portland, are angry about their image being used for conservative causes and, in turn, are using the ad to raise money for Democrats.

6. I believe that they can be sued for about $150,000 per image...
used without permission. Consdiering that they are well-funded, I would sue and have their books opened to find out just what they made off of this ad in terms of media exposure. I would say it's in the tens of millions of dollars. I would then demand that they pay a usage fee of at least 20% of the benefit they received from stealing and using the photo without permission.

In a court, they can win the full amount of the profits earned through unauthorized usage of the photos.

Per their statement, the Oregon paper contacted them to let them know it did not give any authorization - in fact - I think that is how they first found out, by getting a heads up from the paper.

I still haven't found it. It was posted 2/21/05 I believe, the same day as I read the AARP ad first came out. The subject read, "Help! Someone has used our wedding pic in an add against AARP" The text of the post went into looking for legal assistance and how they didn't know until the newspaper called them.
