Military/National Guard people, I have a question ....
I got this from a chickenhawk:

I am 42 yrs old and went down to volunteer for the National guard, because they are under their quota. If you don't know who you are speaking too i suggest you stay quite. I served in the Navy . the National guard told me i was too old. or i would be in the service right now.

Is this right ... I mean, he was in the Navy (if that's true I don't know) and went thru bootcamp couldn't he still join. I know first-time enlist ends at 34 years old, but he's a vet (or says so)

1. Not sure - they recalled a guy I work with in his 50's for GW1
He worked on mine sweepers in the Gulf - not an officer or anything special. I don't know the answer to your question though.

9. That doesn't help - that's for first-time enlisting
This guy was recalled much later - after he'd been out for a while. Here is the only info I could find about re-enlisting:

As a former servicemember, how can I reenlist?
Contact your appropriate service branch or Contact An Advisor.

And this says nothing about a recall during a "war" as he was in GW1.

11. I believe the age limit to re enter is the same
Edited on Tue Mar-01-05 07:02 PM by Retired AF Dem
The only major difference is if you are retired. If you retire from the military you have to do thirty years. So if you retire at 20 years you could be called up for ten years. I'm in that boat now, I retired in 98 and have three more years that I can be recalled.

2. Prolly not....
unless he had some special skill that he could get a waiver for. Generally, though, they don't want 42 year old E-1s.

3. There's a maximum time limit between when you got out
and when you go back in. I don't recall exactly what it was...six, eight, or ten years all ring a bell.
For example, if the limit's 10 years, he could get out of the Navy at age 33 and join the Guard at age 42, but not at age 44.

6. It varies by service...

and the constraints of the National Guard.

For enlistment into the Army and Air National Guard, and with prior service, the maximum age is 59, as long as the member is able to complete 20 years of creditable service for retirement by age 60.

So, if this fellow had four years in the Navy (a standard enlistment for that service) or two years active duty and two years active reserve, he'd be credited with four years of service, meaning he would be able to enlist in the National Guard, because he could conceivably reach twenty years' service by the age of sixty (60-42 + 4 = 22 potential years of service, maximum). Even if he had a three-year enlistment, he'd still be eligible to serve. The only two-year active duty Navy enlistment offered in the past was a special arrangement for 2 yrs. active duty, 2 yrs. active reserve, and 2 yrs. inactive reserve. I think that went away sometime after the conclusion of the Vietnam war.

So, the guy isn't telling the truth, or there is some other reason why he was denied enlistment.

Cheers.

14. If he starts to whine...
... be sure to send him to this page:

http://groups.msn.com/LegalCaselaw/general.msnw?action=get_message&mview=0&ID_Message=1346&LastModified=4675499821362162719

If he says that he can't get into the Guards because he's over 34, this would put the lie to that. The standard is different for the Guards than it is re-entering an active duty service.

Cheers.

7. Here's how it works with the Navy...
Can Veterans Re-enlist With Their Old Paygrades?

Yes. Qualified Navy veterans who have been out of the service four years or less can re-enlist in the same paygrade held at the time of discharge. Those out of the Navy more than four years, but less than 10, may be temporarily advanced to the paygrade held at the time of discharge.

Navy veterans authorized to enlist with temporary advancement must complete all personnel advancement requirements (PARs) for the temporary rate to qualify for permanent advancement to the former paygrade.

Can Other Service Veterans join the Naval Reserve?

Yes. Selected qualified veterans from other services, if enlisting within four years of discharge, can join the Naval Reserve in the same paygrade as when discharged. If they join within four to six years, they will enter one paygrade less than when discharged; within six to eight years, two paygrades less than when discharged.

13. One Rule Is
that you have to be able to complete 20 years prior to age 55. So if he was 42 and he had at least 7 years of prior service, he could re-up.

Different rules for the reserves though.
