Volusia County election records just got put on lockdown
Dueling lawyers, election officials gnashing teeth, Votergate.tv film crew catching it all.

Here's what happened so far:

Friday Black Box Voting investigators Andy Stephenson and Kathleen Wynne popped in to ask for some records. They were rebuffed by an elections official named Denise. Bev Harris called on the cell phone from investigations in downstate Florida, and told Volusia County Elections Supervisor Deanie Lowe that Black Box Voting would be in to pick up our Nov. 2 Freedom of Information request, or would file for a hand recount. "No, Bev, please don't do that!" she exclaimed. But this is the way it has to be, folks. We didn't back down.

Monday Bev, Andy and Kathleen came in with a film crew and asked for the FOIA request. Deanie Lowe gave it to us with a smile, but I noticed that one item, the polling place tapes, were not copies of the real ones, but instead were new printouts, done on Nov. 15, and not signed by anyone.

I asked to see the real ones, and they told us for "privacy" reasons we can't have copies of the signed ones. I insisted on at least viewing them (although refusing to give us copies of the signatures is not legally defensible, according to our attorney). They said the real ones were in the County Elections warehouse. It was quittin' time and we arranged to come back this morning to review them.

Lana Hires, an employee who gained some notoriety in a Diebold memo, where she asked for an explanation of minus 16,022 votes for Gore, so she wouldn't have to stand there "looking dumb" when the auditor came in, was particularly unhappy about seeing us in the office. She vigorously shook her head when Deanie Lowe suggested we go to the warehouse.

Kathleen Wynne and I showed up at the warehouse at 8:15 this morning. There was Lana Hires looking especially gruff, yet surprised. She ordered us out. Well, we couldn't see why because there she was, with a couple other people, handling the original poll tapes. You know, the ones with the signatures on them. We stepped out and they promptly shut the door behind us.

There was a trash bag on the porch outside the door. I looked into it and what do you know, but there were poll tapes in there. They came out and glared at us. We drove away a small bit, and then videotaped the license plates of the two vehicles marked 'City Council' member. Others came out to glare and soon all doors were slammed.

So, we went and parked behind a bus to see what they would do next. They pulled out some large pylons, which blocked the door. I decided to go look at the garbage some more. Kathleen videotaped this. A man came out and I immediately wrote a public records request for the contents of the garbage bag, which also contained ballots -- real ones, but not filled out.

A brief tug of war occurred, tearing the garbage bag open. We then looked through it, as Pete looked on. He was quite friendly.

We collected various poll tapes and other information and asked if they could copy it for us, for our public records request. "You won't be going anywhere," said Pete. "The deputy is on his way."

Yes, not one but two police cars came up and then two county elections officials, and we all stood around discussing the merits of my public records request.

They finally let us go, about the time our film crew arrived, and we all trooped off to the elections office. There, the plot thickened.

We began to compare the special printouts given to us with the signed polling tapes from election night. Lo and behold, some were missing. We also found some that didn't match. In fact, in one location, precinct 215, an African-American precinct, the votes were off by hundreds, in favor of George W. Bush and other Republicans.

Hmm. Which was right? Our polling tape, specially printed on Nov. 15, without signatures, or theirs, printed on Nov. 2, with up to 8 signatures per tape?

Well, then it became even more interesting. Lana Hires took it upon herself to box up some items from an office, which appeared to contain -- you guessed it -- polling place tapes. She took them to the back of the building and disappeared.

Then, voting integrity advocates from Volusia and Broward, decided now would be a good time to go through the trash at the elections office. Lo and behold, they found all kinds of memos and some polling place tapes, fresh from Volusia elections office.

So, we compared these with the Nov. 2 signed ones and the "special' ones from Nov. 15 given to us, unsigned, and we found several of the MISSING poll tapes. There they were: In the garbage.

So, Kathleen went to the car and got the polling place tapes we had pulled from the warehouse garbage. My my my. There were not only discrepancies, but a polling place tape that was signed by six officials.

This was a bit disturbing, since the employees there told us that bag was destined for the shredder.

By now, a county lawyer had appeared on the scene, suddenly threatening to charge us extra for the time we took looking at the real stuff they had withheld from us in our FOIA. Other lawyers appeared, phoned, people had meetings, Lana glowered at everyone, and someone shut the door in the office holding the GEMS server.

Andy then went to get the GEMS server locked down. He also got the memory cards locked down and secured, much to the dismay of Lana. They were scattered around unsecured in any way before that.

We then all agreed to convene tomorrow morning, to further audit, discuss the hand count that Black Box Voting will require of Volusia County, and of course, it is time to talk about contesting the election in Volusia.

I have seen several reports where on election night Karen Hughes was telling Bush at 8:00 P.M. that he lost Ohio and to get ready to give his concession speech, yet Bush did not seem perplexed by this - like he knew something different. Has anyone else seen this?

Yes, I read it at < http://www.commondreams.org/views04/1106-30.htm >. In discussing Bush's then anticipated loss to a Kerry landslide, the article quotes an AP report which stated that "Bush took the news stoically." I remember thinking when I read it how curious it struck me that Bush might be stoic in this situation. Actually, I can't quite imagine him being stoic in any situation. Stoicism implies some degree of introspection and therefore intellect. Well, I guess I might have known. It's easy to put on a good act if you know the fix is in.

What kind of hardware "produces" them? And what do they 'look' like?

Bev - You're the greatest, and we are all tremendously excited by your progress.

What worries me is that you will find that hundreds, maybe thousands, of votes were stolen for Bush in Volusia - but not nearly enough to change the state results, of course. I suspect that this crap went on all over Florida, skimming a few hundred votes here, a few thousand there, and turning a Kerry victory into a Bush rout. Based on what you have already found in Volusia, what can be done to prevent a quick cover-up of the fraud that likely took place in the rest of Florida? Anything?

I'd be very happy if you proved that there was fraud and we get a cleaner voting system for next time. I'd be happier still if we could overturn this election, and get Kerry the Electoral Votes that I believe he rightly won and will make him President.

Again, thanks for everything you're doing. You are our best hope, and we're all behind you!

"For now Metamor accepts the requirement to restrict the server password to authorized staff in the jurisdiction, and that it should be the responsibility of the jurisdiction to restrict knowledge of this password. So no action is necessary in this matter, at this time..."

Moreover, re: the Diebolds and all their problems, there is the below memo. The Diebold machines are very accessible. Your voting count in Gaston county is untrustworthy, therefore.

It's hard to believe that even after this internal Diebold memo became public, Diebold is allowed to operate the machines on election day in 2004. Were the Gaston officials unaware of this?

Also interesting is the reply from Finberg. He says that Metamor (Ciber), who certifies the machines, restricts the server password to authorized staff in the jurisdiction. Diebold people are not in the jurisdiction (by this I assume Metamor restricted access to only government officials of a particular jurisdiction). I wonder if this is still the case.

Its a tough question, and it has a lot to do with perception. Of course everyone knows perception is reality.

Right now you can open GEMS' .mdb file with MS-Access, and alter its contents. That includes the audit log. This isn't anything new. In VTS, you can open the database with progress and do the same. The same would go for anyone else's system using whatever database they are using. Hard drives are read-write entities. You can change their contents.

Now, where the perception comes in is that its right now very *easy* to change the contents. Double click the .mdb file. Even technical wizards at Metamor (or Ciber, or whatever) can figure that one out.

It is possible to put a secret password on the .mdb file to prevent Metamor from opening it with Access. I've threatened to put a password on the .mdb before when dealers/customers/support have done stupid things with the GEMS database structure using Access. Being able to end-run the database has admittedly got people out of a bind though. Jane (I think it was Jane) did some fancy footwork on the .mdb file in Gaston recently. I know our dealers do it. King County is famous for it. That's why we've never put a password on the file before.

Note however that even if we put a password on the file, it doesn't really prove much. Someone has to know the password, else how would GEMS open it. So this technically brings us back to square one: the audit log is modifiable by that person at least (read, me). Back to perception though, if you don't bring this up you might skate through Metamor.

There might be some clever crypto techniques to make it even harder to change the log (for me, they guy with the password that is). We're talking big changes here though, and at the moment largely theoretical ones. I'd doubt that any of our competitors are that clever.

By the way, all of this is why Texas gets its sh*t in a knot over the log printer. Log printers are not read-write, so you don't have the problem. Of course if I were Texas I would be more worried about modifications to our electronic ballots than to our electron logs, but that is another story I guess.

Bottom line on Metamor is to find out what it is going to take to make them happy. You can try the old standard of the NT password gains access to the operating system, and that after that point all bets are off. You have to trust the person with the NT password at least. This is all about Florida, and we have had VTS certified in Florida under the status quo for nearly ten years.

I sense a loosing battle here though. The changes to put a password on the .mdb file are not trivial and probably not even backward compatible, but we'll do it if that is what it is going to take.

84. Volusia County is the county that refused to surrender its votes in 2000
for the recount by the media consortium. That county was eventually sued. The total number of votes which were eventually surrendered (when Volusia lost the lawsuit) did not comport with the number counted on election night. There were a lot fewer votes.

From someone that has dumpster dived on international TV, I salute you.

(The "certificates" are quite real. A friend who has a lot to do with the domestic recyling community at MIT (He AFAIK coined the term "Shopping at Curb Depot" as a euphemism for cruising the streets on trash night) , makes them as gifts for friends. They are painted on a chunk of steel flame cut from an actual dumpster. I supply him with the slabs of dumpster. Don't worry, they are from dumpsters found in scrapyards -- Yes, they do sometimes throw away dumpsters, and crazies like me pay $0.10/lb to hack bits from them)

And she jumps into the Diebold dumpster, grabbing Bob Urosevich's personal garbage. "Take that!" she says, pumping her arm defiantly. Kathleen is a gorgeous 52-year old from Texas who spent 20 years in New York, currently living in Cleveland. She reminds me of Holly Hunter in feisty style.

By the way, Bob Urosevich got fired after his dumpster was emptied, and he apparently admitted that he didn't know what was in it, and that they hadn't shredded crucial financial documents.

Kathleen. She absolutely rocks. Wait until you see her, you'll love her.

And her comment was a dubious, "they couldn't be that stupid". I assured her they could, that they didn't learn from watergate to hide "consulting fees" (the paper trails to the call center jam in 2002 NH, this years $500K to Sproul for their multi-state shred out the vote effort, etc).

Acutally it could simply be arrogance, but stupidity is a much easier explanation... (of course it could be equal quantities of both, they seem to occur together quite often)

I do wonder, with this states sunshine laws, it does seem that access to a shredder should be something very tightly controlled in government offices. They should not be something easy to get access to at the election warehouse.... At least make them haul the bags over to party headquarters, where the shredded remains are clear evidence of a criminal act...

Perhaps, by putting the evidence out there in such a place where it could be found (instead of totally destroying it), he was performing the only act of courage of which he was capable.

Someone more devious would have burned it all instead of laying it out like a buffet for BBV (when it is apparently not trash pick-up day.)

I'm still hopeful that the pollworkers who participated in these "shenanigii" across the country are starting to feel the pinpricks of their conscience by now. I'm an optimist, I guess, but most people (not all, I know) are basically good at heart (even those hoodwinked into participating in such a conspiracy.

The warehouse is located in the backside of the backwoods in Florida, in an unmarked brown building invisible from the road or even off the road. You have to be lucky to find someone who knows where it is. We found a fire department employee who had a family member who had once been to a building near it.

When you get there, you drive through the mud and ask the construction guys, "where the heck is it" and then you go on a police training obstacle course past a chain link fence to an unmarked brown thing.

There is no way in hell they thought we'd find it, much less show up to catch them "recycling" the vote. Maybe this is the Florida version of the Green Party?

Anyway, what we saw was pure "shock and awe" when we showed up. The bag was already out there before we got there. He must have been psychic to know we were coming.

Far from being "laid out like a buffet" it involved a determined tug of war. And as for the trash pick-up day, I doubt there is one way out there.

What it was, was luck. Or divine intervention, however you want to look at it.

Do you think they're actually dumb enough to just toss incriminating information in the trash?

Has anyone provided you, or have you asked for an explanation? IMO, put the question in writing, send it certified return receipt requested and post the letter and the response on your website and let them know you are doing it.

It works the reverse up here Bev, sometimes trying to get any information on local or state projects (boston.com to read about the big dig, even the Globe can't get the straight story) from the ruling democratic party is like pulling teeth but keep at it. Up here they're not dumb enough to leave stuff in the trash, they either whack the guy involved or whack the documents :)

I've always found the certified letter and follow up posting on a website effective.

378. There is this delightful delusion that people who are up to no good often
have. They truly believe that they won't get caught. Therefore they don't tidy up absolutely everything after their misdeeds, and sometimes they even brag.

I saw this myself, in my youthful College Republican stupidity days. I was involved in some slimy things that would best not have been traced back to us. I tried to insist to my co-conspirators that we needed to be meticulous about where we copied the offending leaflets so that there wouldn't be a paper trail; that we needed to distribute them anonymously, at night; that we shouldn't keep any afterwards or throw extras out in trash that could be traced to us, etc. I won some of my points, but for the most part everyone thought I was being paranoid. It simply seemed impossible to any of them that anyone would find us out.

So one idiot, who was copying some of the leaflets at a library copy machine, was so proud of how clever we all were that he proudly announced to anyone who got anywhere near the machine exactly what he was up to. He even showed all and sundry the leaflet. Of course this ended up in the college newspaper.

His excuse for this afterward was that he was trying to start rumors to make our opponents paranoid.

We disavowed having anything to do with him and he was the only one who took the blame. But had there been a serious investigation (i.e., had it been crime rather than slime) we'd all have been nailed.

I canvassed the city of Cocoa during the campaign.

I heard some unpleasant anecdotes specifically regarding the early voting at the Merritt Island Govt complex. The Merritt Island Govt complex was the closest location to the base Dem precincts in Cocoa, so many of our African-American friends were going there to cast their ballots early.

I suggest that as a good place to check out in Brevard, if you can!

Hi...I was at the John Edwards rally in Cocoa, and I heard from people while we were waiting to get in to the park that they had turned African-American voters away at Merritt Island saying that they had run out of ballots. I'm serious-this is what I heard. I hope that someone who saw this complained (like this does a lot of good among the Florida good ole boys anyway). But this was the day of the rally, and it had just happened.

These results are somewhat suspicious in and of themselves. Why such a swing toward Bush on election day?? Roughly about Bush 70,000, Kerry 73,000. Can anybody track how early voters and election day voters break out by registration? Are the absentee ballots predominantly military? This pattern was observed in NC by Ignatzmouse as well.

Check the figures twice and made sure the columns were not switched. I found the voter turnout to be the most surprising of all.

Also, absenteeism being at 14% was pretty high too.

After working in a polling location in Florida, I am not surprised by any of this business. These people will stop at nothing to win and you can take that to the bank, believe me. After that experience on Nov 2/3, I cried then I was depressed, my heart was broken, but then I joined Bev in the BBV crusade. This kind of obstructionism is what I live with every day. Came back last night from an HOA board meeting where I was told by a board member that the Association elected them for the office and they can do anything they wanted, including criminal activities. I have it on tape for the good it will do me. They only gave me a few minutes to speak, so I let them have it. And then I came home and cried. I hate this state.

BTW, if you're going into Brevard County, you might want to see if you can get your hands on the book, "Brevard Good Ole Boys" by Glenda Carlin Busick. It's old, but never dated.

to send them another email (with this link) and tell them if they didn't get off of their asses and cough up some of the zillions that's in the KE GELAC which was expressly intended to PROTECT OUR VOTES IN THIS KIND OF SITUATION then I would never give them a fucking nickel again.

Is there anything we can do to help "lockdown" other counties? The "hard evidence" is paper, right? The shredders will be smoking as this gets out.

Who can we contact? Is there any leverage we apply to help at this point? Bev & Co. are only a few people and there are certainly other places that might be equally "interesting." Demonstrating a pattern, of course, means more than one county.

I have tried emailing BBV once before; in the hopes that you would recruit me for your diabolical purposes. That's rights!, saving Democracy. I have but one idea, which I am sure you folks have already thought of.

SUBPOENA THE PHONE RECORDS TO THE CENTRAL TABULATORS.

Anyone dialing in through a land line would leave a record at the phone company. Compare those numbers with the precinct phone numbers and look for the mismatches. This, of course, is assuming the tabulator phone #'s were dedicated.

239. Subpoena the TCP & UDP logs...
I would get a FOIA to see the TCP (Transmission Control Protocol) & UDP (User Datagram Protocol)log files for the computer that the GEMS server resides on.

It would be possible, (as this server runs on a PC) that whilst the PC is connected to the Internet, someone could open a connection to a port on the computer without having to dial in to it.

My concern is that if you are just looking at phone records you might miss this evidence. Also make sure you get the archived logs. They should be in a folder. Many admins archive the logs on an automated basis.

I'm not sure what you are speaking of, but on your average computer there is no such thing - if there were, it would be massive.

IF there is a firewall that traffic is passing through, then some such logs may be avilable, but otherwise the only place you'll get that kind of info is the ISP, and even then you'd probably be hard pressed to find what I think you are describing.

179. Bev Harris -VS- Volusia - Round 2?

I've been following the BBV site and was surprised this latest development hasn't been posted there (front page) yet. Regardless, I have a couple of questions upon which I hope some can shed some light:

1) I understand Bev Harris has been to Volusia after the 2000 fiasco because of a similar issue:

At the time it was Precinct 216. Now the problem seems to be "next door" in Precint 215 and may very well be blamed on a "faulty" memory card, as was the excuse in 2000. So my question is, since we're dealing with the same cast of characters over at Valusia, are we (mostly Bev) assuming that they (Volusia's BOE) didn't learn their 2000 lesson and are continuing to commit fraud? If so, why didn't Bev Harris' 2000 fraud audit produce enough evidence to convict someone?

2) To the issue of all these "polling tapes" being found in the trash, with apparently different versions or "sets" of the same data, I found this article:

Seems Volusia already did a machine recount of *all* ballots (228,000+ ballots - all precincts) because of a disputed local election. Would this recount produce a new set of tapes? If so, how does this factor into Bev's recent account of what she found.

3) Are Bev Harris's efforts better served at this "scene of the crime" which was a fruitless effort in 2000, or perhaps are her services more needed in Ohio where there is a more likely chance to overturn the electoral votes?

192. You've misconstrued something from Bev's book.
She wasn't in Florida in 2000. She got involved in this later. The information in her book about what happened in Volusia then is good reporting, not forensic auditing.

200. Such recounts don't include the whole ballot
JUST the race in question. So if they had to do a recount for one race, you will only get data on that one race.

Answer: There were massive amounts of fraud in the 2000 election. The 'Butterfly Ballot' was illegal under Florida law when it was used. Can you tell me what happened to Teresa LaPore (a Democrat!) under the control of the Jeb Bush administration in Florida? Therein lies your answer.

Would this recount produce a new set of tapes? If so, how does this factor into Bev's recent account of what she found.

Answer: The original record of the vote count, unofficial though it may be, is a part of the "public record", and as such, any records developed by paid government employees while discharging their duties fall under records retention policy as proscribed by law. They attempted to destroy public records. Ask yourself why they would do that.

Answer: This isn't about "overturning electoral votes". It's about the viability of our elections.

posted 209,052 turnout votes a few days later they added 20.000 more to the turnout i have saved 11-2 on ms word if anyone want this, email me
after the election i sent this to a lot of people it was a kerry win in volusia co but the vote were adding up fast for bush, what if they though we wouldn't look in co. that went for dem there could be a lot of fraud in those co.

This is great! Way to go team!

Now, look at this chart....Projections are derived from party registrations. These Florida counties voted on optical scan.

For instance, look at the first column -- in Clay County, Florida, Bush got 35% MORE votes than would be expected, based on party registration, and Kerry got about 10% LESS. In St. Lucie, on the other hand, registration and vote tally seem to match nicely, indicating less likelihood of tampering (if the chart is accurate).

According to this chart, Volusia was one of the optical scan counties in Florida that had a SMALLER variance between party registration and vote tally.



So, there is plenty of potential for fraud investigation in Florida, if this chart has validity. Just eyeballing it, the counties that jump out are:

Clay .. Okaloosa .. Alachua .. Escambia .. Polk .. Duval

(And, according to another study of exit polling, 90% of people say they voted in accordance with the party they identify with.) More on the chart at

I've been watching the Schrubs since the late 60s. So, I'm not surprised whatsoever. (Heck, I EXPECTED 9/11 and Iraq was a no-brainer.) I don't I expect them to give-up the throne, despite whatever is found.

The worse is yet to come... and it will have to - before enough people realize what needs to be done. 4 more years? They are already prepping his successor for '08. If we don't uprise asap this will go on for a lot longer than that, and as each year passes it will be harder and harder to do something about it.

273. Precinct 215? Is this a typo error?
I really hope it is...

In fact, in one location, precinct 215, an African-American precinct, the votes were off by hundreds, in favor of George W. Bush and other Republicans.

In terms of registered voters 215 is definitely a White - Republican precinct.

Precinct 215 had incredibly low voter turnout. It's also what the DNC would call a "LD" precinct. You say that the numbers "were off by hundreds"? I'd really like to know the actual numbers. Oh, and I'm assuming you are aware that 215 was broken down at the polling place as 215a and 215b? If you are looking at numbers for 215b and comparing them to the actual vote tally I can see where this might be nothing more than an honest mistake on your part.

Just asking the question and I'm hoping that you just typed in the wrong precinct number because if you didn't then it would certainly make your entire post "suspect".

287. In 2000, the problem was with Precinct 216
So that's a good question. I assumed 215 was another black majority precinct, because that's what Bev Harris said and also because it was next to 216.

I hope we can get an answer. There is so much back-patting noise in this thread, it's hard to follow this development.

If there is hard evidence that either of these precincts had "hundreds of votes" going for Bush, then yes, there is a real problem here. But this wouldn't reconcile with the county totals.

And again, very low turnout in these precincts.

If 215 is being used as proof of "fraud" then somebody didn't do their homework.

You're right, the problem is too many people looking at Bev's opinion and then jumping to conclusions. #1 she never stated how many votes were messed up, you'd think if the count was exact she could tell us exactly how many votes by precinct went for Bush, how many went for Kerry, and how many were on the original tapes. The number is somewhere as she was able to determine it was off by "hundreds."

I'm confused in reading what she says about the tapes, did she get some originals or no? If yes, how do we know she didn't toss them in the trash herself?

I'm eagerly awaiting her Tuesday update...seeing as it's now Wednesday night.

BTW, if her reasoning on saying 215 is a "black" precinct is because it's next to 216, she needs to seriously rethink her logic. Talk about a sterotype.

Also, depended on local politicos for the demographics. Looking at the tapes, they said one is African-American and one Hispanic, and pointed to others that they said were minority. However, that's pretty damn weak, isn't it?

The demographics of the districts are in question. I'm pretty sure it was precinct 215 with some unusual results. If it had two machines, that would provide a possible explanation for some of precinct 215. However, it does not explain the 25 or so other precincts with discrepancies or missing records. It certainly does not explain the several poll tapes in the garbage all of which were missing from what they produced for our public records request. It does not explain the people huddled over a table with pens and polling place tapes at the warehouse. It does not explain the signed polling place tape in the "to be shredded" black garbage bag.

You are absolutely right. We should not have included demographics and the precinct number for one of the crazy results, yet. We kicked back and posted this after a 15-hour day in the field. Good learning experience, we'll hold our breaking news for another few days in the future, to get the demographics down, or we'll just skip those details until we can independently verify them.

I think you could argue with them all day and they would still think they were adding to the cause by vetting the facts to avoid looking foolish before the "Real" facts emerge or Don't.

I however am having a hard time finding anyone else reporting on 'Their' efforts to verify the vote.

Even IF you are making all of this up to squeeze a little more money out of a dead bbv franchise you have at least provided the appearance of value for money to your donors.

This IMHO is absurd but still plausible in the "unaccountable blogisphere".

The Dem's have 50 million dollars and all the donors get are cryptic emails from relatives, concessions and surrender on all fronts.

You are a hero.

If all you ever do is provide hope that there may be free and fair election again one day, you will have a place in the heart of those that went along for the journey.

I have no idea what is going on down there so I can only go on the information you provide here. You only mentioned 215 so I took a peek at the county info. It didn't jive.

If you believe that you have solid evidence that there are serious discrepancies in this county with regards to the vote tally, then that evidence needs to be examined from both perspectives. For example...

It does not explain the signed polling place tape in the "to be shredded" black garbage bag.

My questions would be....were these the posting tapes or the tapes provided to the county? Is the county required to retain the polling place posting tapes? In some states the polling place tapes are destroyed. I don't have the answer to these questions, but these are the types of things you should be asking.

You need to determine what is and is not benign before you reach a terminal diagnosis. If a crusty old bastard like me can poke a hole in your case in less than 5 minutes of research, how will it stand up to someone a whole lot smarter than myself?

P.S. If this helps, I am a computer programmer and know how easy it is to alter the votes using the GEMS tabulator program. Didn't take very long, very easy to manipulate!

Way to go, Bev! Here's a copy of a letter that I just sent to dozens of major media figures after seeing your post at Democrats.com earlier today:



Faked voting records, trashed originals, & a cover-up: We know have smoking guns as evidence of fraud in the 2004 presidential election.

Bev Harris of Blackboxvoting.org and her film crew have captured evidence of electoral fraud in Florida. In Volusia County, Bev showed up with Freedom of Information Requests for polling place tapes. She was given new, unsigned printouts instead of originals. The next day, she and her film crew returned and found a trash bag on the porch filled with--guess what? Poll tapes--the real ones. Alarmed election officials called the cops, but couldn't prevent Bev from cross-checked the new printouts against original signed polling tapes. Bev found multiple discrepancies--including an African-American precinct with hundreds of added votes for Bush. An employee hustled the boxful of tapes off to a back room. Then a voting integrity official from Broward County showed up and found mre polling tapes and memos in the election office's trash--destined for the shredder. Lawyers appeared to threaten Bev, but the Blackboxvoting crew didn't back down. Black Box Voting investigator Andy Stephenson then managed to get the Diebold "GEMS" central server and memory cards locked down! We deserve a full and complete investigation by our national media into election results in EVERY state. We know the shredders are humming all over Florida and Ohio and whereever else the fraudsters are doing a little preventive maintenance. If Volusia is proven to be a case of blatant, deliberate fraud and its count is contested successfully, what then? What can be done FOR THIS ELECTION? The country -- and the world -- may not survive another four years of the Bush thugs.

Bev and her valiant army can't do this alone. More power and coverage is desperately needed to pursue what must be done NOW. Has anyone gotten any response from the DNC? This is such a turning point, and the suspense is killing me. They won't be able to dismiss it all as tinfoilhattery now, but there's so much more that has to be done to get the truth out. 300. Just send a public records request via certified mail
Instead of being confrontational with underpaid, overworked government officials (I'm joking of course), just put exactly what you want in writing and send it certified mail return receipt requested. They've got 10 days to fork it over, if they don't the SoS has I think 30 days to produce it.

I learned a long time ago two strokes for every poke. When you go in accusing people of things, they aren't going to be very helpful.

If what you are saying is true I hope you count all the counties. If you find more than the normal margin of error swings in each county I'd gladly contribute to the cause. I just hope you are documenting with the video camera all the "evidence" so everyone can see with their own eyes nothing was tampered with on your end. Otherwise, the other side will just claim you tampered with the results and how would anyone know?

and demanding documentation of the election on the spur of the moment. :eyes:

That said, I must add that Bev is a veteran at this who knows the law, she knows what documentation must be turned over, and when it must be turned over by. When it comes to dealing with these people she is professional and no nonsense. If you attempt to stonewall her or give her something other than what she's asked for, and is legally entitled to, watch out. You would not believe the amount of unwanted exposure she can bring upon those who fail to fully cooperate with her lawful requests.

With a single request to her 'hoards of willing minions' she can turn a politicians life inside out with hundreds or even thousands of calls, faxes, letters and e-mails an hour from people who wish to let them know that we're all watching and waiting for them to do the right thing! :)

I want to thank you for your efforts as a former DeLandite.

My Dad is a college Prof at Stetson (here's his new site where he rants about the election for anyone who is interested: http://www.agrippinaminor.com/rants/).

My Mom was heavily involved in GOTV (phoning on her cell phone while visiting me up in Georgia!) as well as a poll watcher and told me some hair-raising stories.

Are people being arrested? Are FBI agents crawling all over the place? Are the original signed tapes and the newer tapes Bev was given both secured somewhere? Has a filing being made to contest the election, as implied?

There was a meeting this morning with all the players? What was the outcome?

Andy hinted that there is more? What and when? How does this relate to the deadline for asking for a recount?

Media exposure doesn't matter much to me at this point. I'm interested in knowing what the follow up is and who is doing it. Are we getting deeper into Volusia or is it going to disappear?

Is this another one of those things that gets explained or is it a real issue. There have been so many false alarms it's tough to weed through. This seems legit, but I just find it astounding they'd be dumb enough to carelessly discard tapes.

353. EVERYTHING in Boston says it's over...radio, paper, tv
I heard Mike McCurry today, excellent PR guy. The insiders on talk radio here in Boston and Providence, the real hard core democrats really are scoffing at the blogs. It isn't because they don't think there are some votes to be found, but the recurring theme is "wake up" and realize the election process has never been, will never be, and wasn't this time, anywhere near perfect.

They are talking a lot about 2008 here, and Kerry was all over every Boston station last night and today. When asked about the recounts etc he's said the same thing. One reporter even ran the numbers in saying there are 155k votes in Ohio, even if 90% are counted and 8 out of 10 go to Kerry he still loses by 1-2%

Everybody is focusing on the 155k. Again, not to throw cold water on it but:

155,000 votes, let's same 10% more are counted this time than in 2000...90%

139,500 new votes total.

John Kerry gets 80%...which is way more than he probably will based on the counties counts. 111,600 new Kerry votes and 27,900 new Bush votes. That's still 40K plus, 1% or so. This is basically the party line in Boston, it ain't going to happen. Change the provisionals to 80% total accepted and it's closer to 2% for Bush...it just can't change the vote enough.

I posted it over and over again but nobody listens. It's been widely reported in the Boston media, including the liberal rag the Boston Globe, that Kerry equaled or exceeded their BEST case number of votes in Ohio. Unlike Florida in 2000, there aren't votes out there that they thought they had. They got what they had dreamed of, the other guys just turned out more.

I hear what people are saying and look forward to the recount, but nobody is paying any attention to the fact that here in Massachusetts Bush did 5% better in 2004 than in 2000. That's with Kerry being a 20 year Senator here....says a lot IMO.

I have to say I'm very glad to see your last comment..."clean up elections, on both sides." What may have happened in Florida may have happened in PA, WI etc. It's a problem nationally that elections are run with less scrutiny than Sunday afternoon bingo!

Bev I'm just trying to put this in perspective. I agree the system should be better, but consider these numbers which are publicly available:

In 2000 after painstaking recounts:
Volusia in 2000 had originally 179,277 votes. After a deliberate hand recount they had 179,661 votes...the net error was .214%
Pinellas had more lost votes in number, but in percentage it was less.

The general theme in Florida and in other states that have done recounts is about an error rate of .15%. If that happened in Florida in 04 you are going to find about 20k votes across the State. It doesn't mean anyone cheated, it just means the FEC guidelines of 1 error in 500,000 is a total and utter joke. It doesn't surprise me that you may well have found a few hundred lost votes, but as sad as it is it's typical.

Good luck in your searches. I applaud your efforts and hope that the energy being expended doesn't diminish once everyone is comfortable with the results. With a lot of effort maybe by 2012 we can have an election system that counts every vote, everywhere.

It was one of the lead stories where they basically make it out that there is some dissent in the party, and disgust that he left money that could have won the election in the bank. The general theme is they will find a way to make him fork it over so he's not starting off with a 15 million war chest over hillary et al in 08.

336. Optiscan tapes maybe?
Optical scanner machines produce a long tape like cash register. The precinct judges are supposed to run a tape before opening polls, and that tape is supposed to show zero votes in all races, to demonstrate that no cheater votes have been retallied.

Then after polls are closed, the tape is run again, and this result may be called in to county HQ. This is if counting is done at precinct, as it in my county here in NC. However, here they do not call in the result until the ballot box is opened and the rejected ballots are counted by hand and added to the total.

The absentee ballots are counted at the elections office and added in separate column, so separate tape for that.

This year, because of early voting, the totals for early votes were reported to public at same time as absentee (middle of night Nov.2/3?) and put in same column. However, not clear how many tapes this would generate. Probably 5 as we had 4 early voting sites, one machine at each, though it could have been that the ballot box part was replaced, I don't know.

I digress.

Anyway here the handcounted votes are I believe then added to the count and the whole reported.

In any event, these are the tapes that are signed, by the precinct judges and if there are extra signatures on the Volusia ones maybe these are signed as received....

It does appear that in Ohio, however, the so-called spoiled ballots are not examined or counted.
(See Greg Palast's article "Kerry Won" supposedly 92,000 plus but if they don't examine them, how know how many? (This could be info obtainable from the counter on the machine or number of voters, I really don't know.

Optiscan machines have to programmed to read the particular ballot, so gaming them is theoretically possible I guess, though it's just as easy to do it non-electronically given the secrecy of our vote counting.

But the bottom line is this, all the generated paper should have been retained, and explained.

Message to Bev Harris, don't forget to demand to look at the voter books too.

My first impression of this -- obvious criminal behaviour on the part of Volusia county elections official. I'm thinking of something that's potentially damaging to the Bush admin, like Watergate was to Nixon, "the shit has hit the fan", to use John Dean's expression.

Now it's going to be deniability and CYA and perhaps even outright perversions of the judicial system, a system that is slowing being permeated with the Republican rightwing. Remember it was the Republican-dominated US Supreme Court that decided the outcome of the 2000 election.

And how will the corporate media choose to downplay this? Ignore it as a trivial matter?!!!

When I first read this, I immediately came out of my depression from yesterday, after reading of the Iraqi POW execution by the Marines in Fallujah. Although I am not yet proud to be an American, Bev Harris is starting to help me see the light at the end of that large, dark tunnel of the Bush fascist dictatorship. I hope it all caves in and falls apart on them ASAP.

You can be confident by the actions of these thoroughly corrupt officials in Daytona that it is really the TIP OF THE ICEBERG. The Republicans will be calling in a secret army of seach-and-destroy goons to work on fixing this problem.

God, I hope this thing will snowball like Watergate.

Including, you, me, and Bev Harris. I salute Bev for her wonderful work. I believe she will be one of the heroes that saves our democracy. But if the law of the land is to not criticize a fellow democrat, progressive, or other, then I'm afraid it's not much of a democracy we're fighting for...

364. Kerry left 15 million unspent in a tight election?
Anyone see this story today? Boston talking heads are all over it tonight. I guess it's causing quite a stink because some believe if he'd spent the money he could have won. Nobody knows why he either didn't spend it, or didn't give it to down ballot objectives.

You know, we can go round and round on the ballot and tape situation, but the more you read stories like this, the more aggravating it is. All these people worked all these hours and raised record amounts of money and apparently JK decided he wanted a nest egg...for 08. It looks and reads more and more to many in the democratic party that Kerry was his own worst enemy.

Mr. Blackwell: what was going today in Volusia county (OH), when there is a FOIA document to cause you to turn over the records?

Here is the BOE results:

Provisional: 621
Early Voting: 40,077 (12%)
Total Votes: 228,839 (73.8%) <- Pretty high turnout

How they voted:

Absentee: 24,780 (56.6%) Bush , 18,672 (42%) Kerry
Early Voting: 15,819 (39.4%) Bush, 24,064 (60%) Kerry Why are there such huge discrepancies here?
Total County: 111,859 (48.8%) Bush, 115,484 (50.47%) Kerry

Precinct 215 Results:
Registered Voters: 2364
Votes Cast: 880 (37%)
Results: 520 (59.1%) Bush, 351 (39.9%) Kerry

Why was the GEMS Diebold server being held hostage when all we seek to understand is what the vote was, Mr. Blackwell? Please advise: the country wants to know.

I would not be so concerned except the fate of the country is bound together, each state to the other. This is a UNION of states, Mr. Blackwell.

Ken Blackwell is the Secretary of State of Ohio.

Volusia County is in Florida. The Secretary of State there is Glenda Hood.

390. A Message from call center volunteers and poll watchers, Precinct 603
Hi...this is Dawnne and Carol Howarth. We volunteered at call center (my mother Carol more than me-she had a lot more time) and were both poll watchers for Precinct 603 (Precinct 530 was also located at Highlands Presbyterian Church, Daytona Beach along with 603). I just have to say a few things...first, I want to thank two very good people, T.O., who was the poll clerk and also did a lot of great volunteer work/canvassing, and LaWana, a poll worker who made both me and my mother feel welcome (I did the 6AM-1:30PM shift and she came in to relieve me). Bob and Steve, our lawyers, were fantastic too. I'd love to talk to anybody who we had the pleasure of working with-we miss you all. Now for the observations/reasons why John Kerry's margin in this county had to be higher than the reported 51% to W's 49%, and also some other not-so-pleasant observations that we made that day.
We had the misfortune of having a Republican poll watcher at #603. First of all, he set himself up on top of the provisional ballot box, and I mean this literally. Second, he was handling spoiled ballots with a poll worker fully aware of this, and she said nothing. This poll worker appeared to be acquainted with him. They had repeated, whispered conversations throughout the day. Something was not right here, and I both took notes on all of this, which I still have, and also reported it to the desk (at headquarters). Another bad observation that I made was this-the alarming number of people coming in, African-American, who had requested absentee ballots and never got them. They did get to vote, with a regular ballot, but HOW ABOUT ALL OF THE PEOPLE WHO REQUESTED ABSENTEE BALLOTS WHO DID NOT GET THEM AND WHO WERE UNABLE TO COME TO VOTE FOR ONE REASON OR ANOTHER, e.g., illness/confinement? Nobody out there can tell me that this was not an example of racial profiling. I'm sure the lovely and talented Deanie Lowe could make a decision to who she wanted to send ballots to. It's inevitable. At the cal center, we were encouraging people to use absentee ballots, so that their vote would be counted. Well, not getting an absentee ballot when one was requested or the failure to count absentee ballots which seems widespread seemed like it cheated people. And then with early voting-how do we know if those votes were counted. Come on, this is a Democratic county, I am proud to say and am happy to live here, but because of that, we know that this would be a powerful area in the Republican mind to "rip off." I haven't slept well these past two weeks at all. In both precincts were located at the church where we were, John Kerry won. In #603, he won with about 80% of the vote. In #530 he won by between 50-60%. We all see the new events taking place that were "planned" for right after the election, e.g., Fallujah. Everything that is happening is a distraction so there is no investigation. Thank you, Bev, for caring also, and standing up for what is right. Never doubt, please, never, that there is no such thing as racially profiling and discriminating. It is alive and well, I am sad to say. When I lived in New Jersey, my neighbors on one side were African-American, and on the other were Jewish (the property taxes there were just too damn expensive at 4K+ a year). Most people in NJ know what it is to live alongside others of diverse backgrounds, most-I am not saying all. The state of Florida really needs some lessons in acceptance and how to get along with others. This "rebel" mentality has got to go, all of this hate that makes people vote for dictators like W, who says that they can have assault weapons if they want. Maybe then these things wouldn't happen. The funny thing is that when my mother and I were in the bar on Beach St. in DB, watching the results come in, I was so so so afraid that John Kerry would lose New Jersey (my home state) since the Jim Mc Greevey scandal (he resigned on the 15th from the governorship-he was a nice man but he had way too many problems to be governor at all), and I felt such a great relief when it showed that NJ went Democratic. I was positive that Florida would also. I didn't have a doubt in my mind. This just couldn't have happened. It just doesn't make sense.
