A different type of drug test question
When you apply for employment at a company who drug tests, do they keep records if you fail the drug test? Are they prohibited from sharing this information with anyone else, like other companies, the police, or other? I know someone who has been looking for employment and has not received interviews after failing a drug test at a company to which he applied. I thought that perhaps it was just a coincidence but my husband went to a job fair. One of the temp agencies had the question: "Have you taken a drug test in the past six months? What was the result?" Why would that question be there unless they could someway find out? If this is the case, it seems rather unethical and effectivelty blacklists people. If this is not the case, I hope that the Bush administration doesn't come out and advocate this.

2. Good question! here is my stab at this:
I've collected pre-employment and post-accident drug screens and BATs(breath-alcohol test) for 15 years.

In the urine drug screens, the 'donor"signs a waiver giving the testing company permission to release the results to the donor''s employer.

by HIPPA requirements, a company who gives the information to another company may very well violate your rights under the HIPPA laws.
Health Information Portability and Priavcy act.
You would need to check. go to your state's homepage and check on medical privacy laws. drug screen testing regulations, etc.
