ATTN: Parents! Do your kids...........
Have Civic in school. I am 54 and have NEVER had a civic class. Everything I know about our government including the Constitution I learned by candle light!

A while back we were debating on whether Clinton qualifies to be our VP nominee......I asked 3 Law school Professors and got 3 different answers.If they have no idea how will the kids learn? No wonder no one has nay appreciation for what the Patriots Act is doing. they never read the Constitution.

The jurry is still out on the 22nd amendment....until you look at the 12th amendment.

There has also been some heated discussion on a possible loophole in the 22nd amendment that might allow Bill Clinton to serve beyond his prescribed constitutional limit. There is nothing in the language of the 22nd Amendment that precludes a former president from becoming vice-president. So, for example, John Kerry could run for president in 2008 and name Bill Clinton as his vice-president. Upon the death, incapacity, impeachment, or resignation of the president, Bill Clinton could then assume the office. There is a statement in the 12th Amendment which appears to cover this loophole, however: "But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States."

What were the three law school professors answers?

10. You nailed the problem exactly.....
I believe and so did 2 of the 3 that the spirit of the 22nd is that BC could NOT be VP...but it is not well written. Under the 12th he would qualify.

11. We had civics and
a class called "Problems Of Democracy" in high school. (Back in uh, 1988 or so) But I learned most of what I know about government from listening to my parents and learning from the knowledge they passed on to me.

My son is now 11 years old and while he hasn't had any government courses in school he's more educated than most college students about government. He gets that from me. :)

12. Social justice is included in our Civics
curriculum. Our children study, research and work on projects about issues relating to economic justice (fair trade, living wages etc.), Conflict resolution, Voting issues, comparative politics, comparative religion, criminal justice issues in America and elsewhere, they also study and practice foreign language. They also study world governance issues ( they actually know what civil society is and what an NGO is)

Our oldest (12 yr) is working on a project that will take her to another county (Nicaragua) to see first hand the results of fair trade practices on a specific group.

Volunteering in the community is also a mandatory part of the civics curriculum and both of our children do so. ( organize events, teach, volunteer at a fair trade gift store, work with a local environmental group and they even take water samples in a state run program for clean rivers)

They recently finished a first amendment unit. Our children have actually read parts of the patriot act as well as the constitution. Our children attend and report on political rallies and they have attended anti war rallies with us.

Our civics curriculum is great! We home school. ( of course we must be child abusing christian fundamentalists as so many say HS's are!)

13. My son is studying civics right now
in 7th grade. He has a good teacher and the curriculum is posted on the school system's web site. He has a test on parts of the Constitution today. I'm happy with what he's learning, but I hope it doesn't stop here. Hopefully the study continues in high school.

16. I'm about your age & had 2 years of "Government"
One in Junior High & one in Senior High. (That was before "Intermediate School" was invented).

I also had at least one semester of Texas History & another of Texas Government. Believe me, the Texas Constitution is not one of the masterpieces of political thought.

19. Your question doesn't have an easy answer
I'm not surprised 3 law professors didn't give you 3 identical answers. Your question on whether Clinton qualifies to be VP depends entirely on the Court's interpretation (since it would most certainly be challenged) of the phrase "no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States." Whether the 22nd Amendment comes into play is a matter of opinion.

21. He's not (very) eligible
The VP must be qualified to take over from the Pres. at any time, including the day after his innaguration. If Clinton were VP, and then the Pres died early in his term, Clinton would only be able to serve two years as pres, and would then have to step down.

By that logic, my guess is that the courts would not allow a former two-term president to become VP.

22. Re-read the 22nd
It doesn't talk about eligibility to be president. It says he can't be "elected" president, not that he's inelgible to be president.

Take a similar case to being VP. If Clinton became Speaker of the House and then president and VP both died, would Clinton be president? The way I read the 22nd, his succession wouldn't be a problem in this case. That would lead me to think that he is eligible to be president again.

There are two routes to the Presidency: election and succession. The 22nd Amendment places limits only one the election route, leaving the succession route completely untouched. Thus, given that this succession route to the Presidency is open, Clinton is eligible to hold office and can serve as Vice President under the 12th Amendment's requirements.

Hell, if Clinton wanted to, he could set-up a trustworthy dummy candidate: "John Doe for President." And John Doe's candidacy could revolve around one stance: "I will name William Jefferson Clinton as my Vice President. And if I win, I will resign one hour into my term, allowing Mr Clinton to ascend into the Presidency."

And it'd be perfectly legit.. as far as the letter of the law goes..
