Can Bush be tried as a war criminal?
Read today that the Mayor of London, Ken Livingstone, thinks that Dubya should stand trial. Could this happen? Im sure it won't but it is a possibility right? As commander-in-chief surely the blame lies at his feet.

1. He passed some law that said he was immune from war crimes.

before we even went into Iraq.

I think it said something to the effect that they wouldn't recognize the Hague.

U.S.: 'Hague Invasion Act' Becomes Law
White House "Stops at Nothing" in Campaign Against War Crimes Court

The new law authorizes the use of military force to liberate any American or citizen of a U.S.-allied country being held by the court, which is located in The Hague. This provision, dubbed the "Hague invasion clause," has caused a strong reaction from U.S. allies around the world, particularly in the Netherlands.

2. So he can really do that?
That's ridiculous. How come Milosevic didn't think of that then? He could be at the ranch right now!

4. The US has a resolution before the UN at this very moment
asking to be exempt from war crimes for another year (our exemption expires in June). Was supposed to go to a vote today.

Why is this resolution necessary?

3. Yes
He's violated not only the Geneva Conventions but the UN charter (both of these agreements were in place 50 years before the ICC came about).

5. He is already a convicted war criminal
George W. Bush was convicted as a war criminal by the International Criminal Tribunal for Afghanistan. I can dream and hope the brass in Carlisle at The War College will take him into custody this evening.
