The judges are mostly Republican appointees. Though, I suspect that being a Republican in Massachusetts isn't the same thing as one in Alabama.
Kerry's position is pretty clear. He's against gay marriage against gay bashing and pro civil unions. He believes the whole issue should stay in the states where it has traditionally resided.
However, this issue will get really hot between June and November. Gay couples will marry in Massachusetts and then go to other states and promptly begin suing. Kerry's position on this will be much harder to negotiate.
in your comparison of Massachusetts & Alabama Republicans. In fact, having lived in AL and participated in my local Democratic party, I would say that it's quite possible that many Massachusetts GOPers are more "liberal" than the Alabama Democrats that I knew. There are quite a few Dixiecrats still running loose in NE Alabama.
