Priscilla Owens gets to decide if the Texas D's should cave!
The Texas Supreme Court is considering Perry's lawsuit to end the redistricting walk out.

Of the nine on the court:

-Priscilla Owen, nominated by Bush to Fed court, has been blocked by Dems THREE times.

-All are repubs.

-Two were appointed by Perry.

-The AG handling the case used to BE on the Court.

This article tells about it:

"I would be shocked if there was not some reason for (Perry and Dewhurst) to believe the Supreme Court would take it (the lawsuit)," said Sen. John Whitmire, D-Houston, "and I wouldn't be totally shocked if they already knew the outcome."

But Jim Dunnam, chairman of the state House Democratic Caucus, said he believes the Republican leadership's lawsuit is flawed in asking the court to violate separation of government powers.

He said a court simply cannot order a legislator to take a specific action, including attending the legislature.

3. Lovely. As usual, Bushco has not considered the consequences.
If they order them back, the matter has to go to the Supreme Court.

If the courts can order the legislature, they can also order the executive to enforce the order. Making the judiciary the supreme power in the land.

They can also order the legislature to do things unwanted by the executive.

They can do anything.

Rehnquist all, George nothing.
