If Gray Davis were to resign..

If Gray Davis were to resign..
would there still be an election? Bustamante would ascend to the office of governor, correct? How can you have a recall when the object of the recall - the person on the petitions - is no longer in the target office?

PREDICTION: If it looks like he'll definitely lose, Davis will resign right before the recall vote.

2. It may not be that simple.
There is some bad blood between Bustamante and Davis from the past, so Davis may not be willing to cede the Governorship to him.

Yes there would still be an election! The LT. Gov is not like the VP
that's why Cruz is now running. If Davis had resign before the recall was certified then there would be no election and since 40% of the people who signed the recall were Democrats Gray should have smelled the coffee and step down the day Kevin Shelly was going to certified the recall My guess they tried to get him to & he refused

There's so much speculation on DU about this.....but no one can seem to identify the process if Davis resigns.

And if it is clearly a bustamante ascension to the gov's seat.....then LORD.....just shut this circus down and have Davis resign. Even though Bustamante is DLC.......I still think assuring a democratic governor is THE MOST important thing.

6. Post #3 is the short version
Basically, If Davis resigned before the petition was 1)Filed or 2)Certified (depends on who you ask), then he could have stopped the whole mess, saved the state 75 million bucks, and ensured that Bustamant would take over, thus keeping the state in Dem hands.

Davis can wait till that last moment and resign, but it will change nothing. The vote process will go on, and the outcome determines the next step. If the recall is voted in, then the results of a second vote, taken at the same time as the recall vote, where the people of California choose a replacement Governor, will be tallied.

In this vote, the candidate with the most votes wins.

It does not matter if three people vote, or three million. It doesn't matter if no candidate gets over 1 or 2% of the vote. Whoever has the highest percentage takes over the office of Governor.

However, I believe that Davis should get out now. It may not stop the vote, but I think it will take all the steam out of the "Get Rid Of Davis" vote. Bustamante would be acting Gov, and could run to keep his new office. I think the Latino community would GOTV to support this, and possibly defeat the recall before it left the ground.

That, I believe, would be the ultimate kick in the ass to the Repulicans.
