UAW Wins Court Victory For Card-Check Organizing Agreements

In an important victory for workers and the United Auto Workers union a judge has dismissed a National Right To Work Legal Defense Foundation lawsuit against the UAW at Freightliner. The lawsuit attacked the card check agreement the UAW used to organize Freightliner. But the judge said in his ruling “Participation of unions and employers in card check programs is proper and has never been held to be illegal.” Card check is where workers sign union cards and the employer agrees to recognize the union when a majority of workers have signed up. Federal Judge Graham Mullen said if courts “were to find card check agreements illegal it would have the effect of criminalizing all collective bargaining agreements.” UAW President Ron Gettlefinger says this ruling means you can’t use the courts to overturn democracy. When a majority of workers sign union cards their right to organize is clear. Freightliner workers in three states have gone union.
