Gov. Ernie Fletcher's personal lawyer declared victory Friday after a judge ruled the governor could not be tried while he is still in office on charges of violating the state's merit system laws.

But it wasn't much of a victory - not for the governor, and certainly not for Kentucky.

Fletcher, the first Republican governor in Kentucky since 1971, has only himself to blame for the mess he's now in. He campaigned, after all, on a pledge to clean up Frankfort, to end politics as usual. But the evidence in the public domain argues strongly that, almost from the beginning, members of his administration has been doing exactly what they'd earlier criticized: awarding merit system jobs (which are supposed to be beyond the realm of politics) as political favors and making a concerted effort to weed out Democrats who had burrowed into merit system jobs.
