Fla. High Court May Hear Limbaugh Case

The state Supreme Court was asked Wednesday to decide if prosecutors violated Rush Limbaugh's privacy rights when they seized his medical records without warning during an investigation into his use of painkillers.

The 4th District Court of Appeal asked the high court to consider whether patients should be notified before their medical records are seized or inspected.

Last month, the appeals court rejected the conservative radio commentator's claim that his privacy rights trumped investigators' power to seize his medical records. Limbaugh appealed, asking the appeals court to rehear his case or refer it to the Supreme Court.

The Supreme Court could decline to hear the case, which would allow the lower court's decision to stand.

the ACLU on his side in this one. Personally, I think they have too much integrity. They should have said screw him and not filed on his behalf

13. Too bad they won't help juveniles being tried in Florida as
adults, or juveniles that die while ties to a chair screaming in pain.

They only want the high profile cases.

2. Wouldn't this Privacy issue fall into the same Patriot Act provision
that permits law enforcement to search your house without your knowledge, and access your library records?

I'm not any attorney, but it sounds to me that this would be the same issue that we've all been fighting against in the PA. as being wrong.

3. Florida Supreme Court.............love and hate from repukes
They called them an activist liberal court when they ruled against Bush in 2000 recount and then loved them when they ruled Nader should be on the Presidential ballot in 2004. Look for hate if they rule against Rush Lowbrow and fall madly in love if they rule for the low life.

Martha was busted because she is a woman who is a known Dem. Rush is a known :puke:, with NO morals, a completely and utterly unAmerican, unPatriotic CONSERVATIVE with the thickest of knee-pads. He'll walk.

5. Addicts usually develop more humanity
after they're recovered (I know. They're always recover-ing.) but I don't see that in Rush. There's little or no humility - just arrogance.

Maybe he needs more time...in jail!

12. You got that right...
Limbaugh is nothing but a liar and always has been. I knew him when he was quite a bit younger, knew his family also. Was raised near them for a few years before my parents moved to St. Louis. His whole family think they deserve anything they want and none of them believe they should have to work for it. Rush's father was always upset with Rush. You do realize that Rush got a medical deferment because of an ingrown hair on his fat ass?

16. I have this mental picture
of Rush's dad and Archie Bunker being one in the same. Rush has said how all of his friends would come over and marvel at how 'brilliant' his dad was. He would go into these tirades about the evil, hippie, commie, liberal, traitors and his friends would sit there 'spellbound'.

Limbaugh is protected. He is Amerikka's chief propagandist. He will never be subject to the law like the rest of us. He is above the law, and we will soon find that out. For all intents & purposes he's an addict who used his maid as his drug mule. Where's all the outrage from the "Moral" Right Wingers? Dont see them upset about Rush or O'Reilly for that matter. Hypocrites.

18. With his stand on gay rights wouldn't Limbaugh 'enjoy' prison?
maybe I saw too many episodes of OZ on HBO but I was just wondering if Rush may have been spared a truly eye opening experience complete with insight into both homosexuality and rape? Don't get me wrong, assault is a terrible thing even if the victim is a fat moron but the potential irony!
Imagine a Limbaugh released from jail after months of close and personal contact with his lonely cellmate: a new Limbaugh emerges not only pasty white from the cell but newly out of the closet and ready to profess his love for his long lost soul mate.
Truth is stranger than fiction, would a new Rush embrace gay marriage just as another man would likely embrace him? Would he flee off to Massachusetts and tie the knot or would he settle into The South Beach lifestyle surrounded by teary eyed republicans who have lost their leader.
Just a thought. hehe.

If Limbaugh is closeted - he would have much work to do in the gay community. He and his prison lover would not be popular. He's said so many mean things about Barney Frank, that most gays would probably still hate him.

Rush Limbaugh
Of Limbaugh’s many targets, it is hard to pick a favorite. But if you enter “Rush Limbaugh” and “American Civil Liberties Union” or ACLU into an Internet search engine, you’ll get 8600 results.

Sample items taken from Mr. Limbaugh’s own website:

September 12th, 2003:
“If this guy had burned that flag,” Limbaugh said, “the ACLU and countless other groups would be down there supporting this guy’s right to desecrate old glory. But because he’s flying the American flag respectfully, none of the so-called civil libertarians makes a peep.”

September 23rd, 2003:
“The ACLU has decided they’re not going to appeal the Ninth Circuit’s decision to reinstate the California re-call election... They must not really care all that much about you stupid minorities and poor people.”

December 23rd, 2003:
“Where have all these so-called civil libertarians gone, the ACLU and the rest of them, claiming our government is overreaching?”

Maybe I’m over-reaching, but I don’t think Mr. Limbaugh likes the ACLU. And something else he has shown an antipathy to—the right to privacy. Again, from his own website:

August 22nd, 2003:
“I warned you about this ever-broadening interpretation of the so-called right to privacy. It’s not a ‘right’ specifically enumerated in the Constitution or Bill of Rights.”

A quote that makes an odd preface to this next one:

December 23rd, 2003:
“Now they need my medical records, my private medical records to find out if I’ve committed a crime called doctor shopping? They now have to invade my privacy to learn whether I have broken the law?

Yesterday, the ACLU filed a friend-of-the court brief supporting Mr. Limbaugh’s argument that the seizure of his private medical records was illegal, and Limbaugh gratefully accepted the ACLU’s help.

His attorney Roy Black said he and Limbaugh quote “are pleased that the ACLU has filed a motion” and added the seizure was, “also a threat to everyone’s fundamental right to privacy.”

To say nothing of (as Mr. Limbaugh and Mr. Clemens would tell you—if they were talking about somebody besides themselves) everyone’s fundamental right to change their opinions on a dime, and contradict months and even years of their own conduct and beliefs – these demostrate everyone’s fundamental right , the un-generous among us might call, to hypocrisy.
