.. the judge, I BELIEVE than means Al Franken (or rather Penguin Publishers) has cause for sanctions to force Fox to pay their legal and court costs.

I believe that means the burden of proof is on Murdoch to "show cause" why he should not pay all expenses.

NEW YORK — A federal judge on Friday denied Fox News Channel's request for an injunction to block humorist Al Franken's (search) new book, which uses the Fox slogan "fair and balanced."

U.S. District Judge Denny Chin said Fox's claim was "without merit, both factually and legally."

The network had argued Franken's book -- "Lies and the Lying Liars Who Tell Them" -- could trick some consumers into believing the book is associated with Fox.

The book's subtitle is "A fair and balanced look at the Right." Fox trademarked "fair and balanced" in 1998.

Ever notice though, there are no quotes from the judge's opinion in there (stuff about it being not strong enough of a case), even though it rehashes parts of their complaint we've been reading for days?

Why would Franken's performance at a dinner have anything to do with this lawsuit?

If Fox claims that Franken is shrill and unstable, would they have had to prove it in court if the case had moved forward? What does shrill and unstable have to do with a book title? What kind of shrill - the timbre of his voice or his writing? How is he unstable - did he not make his car payments or does he wobble down the street?

Lawyers please? This lawsuit must be an O'Reilly special. It has all the indicators of irrationality.

FAIR ADND BALANCED may have just become the joke of a century. It's sure to bring a smile to the face. Yeah Al!
