The execution of Troy Davis was delayed temporarily by the US supreme court on Wednesday night, in a dramatic intervention just as he was due to be put to death by lethal injection.

As the first news came in at the Jackson prison that houses death row, a huge cheer erupted from a crowd of more than 500 protesters that had amassed on the other side of the road.

Davis's supporters kissed each other and threw placards which read "Not in my name" into the air.

But the jubilation was short-lived. Talk of a reprieve from the US supreme court quickly gave way to rumours of a stay, and finally the realisation that the court had only ordered a temporary delay as it considered the matter. The mood then grew more sombre as the waiting game that has now been going on for years with Davis resumed.

Hey I'm an old guy, who had to wait for the morning newspaper 20 years ago to find out stuff like this...

Just remarking from my old age.

I hope a few hundred thousand tweets and appeals to every lawmaker in the state and federal system helps hold this off.

This case needs a retrial, at the very least, given what even jurors and we all know now!

edited to add:
One of the three vids at the ABC link is very confusing it states the SC has cleared the way for the execution, I hope it is incorrect.
I'm wrong they were referring to The Georgia Supreme Court.

19. I cannot stand all the unnecessary drama the SCOTUS always seems to bestow



when there is an execution involved. They could have looked at the case earlier today, or yesterday, or whatever. We are such a fucked up country.

21. Yeah, facts in the case demanded a re-trial over 10 years ago...
but we only find out about this on the day of the planned execution?

We are a strange nation. Europe and Canada and so many other nations are scratching their heads wondering if there is ANY working criminal justice system at all in the USA these days.

Failure to Disclose: Federal judges and justices are required by law to disclose their spouse’s income — thus preventing persons who wish to influence the judge or justice from funneling money to them through their husband or wife. Nevertheless, Thomas falsely claimed that his wife Ginni — a lobbyist and high-earning member of the professional right — earned no non-investment income whatsoever while she was working at the right-wing Heritage Foundation. When asked to explain this error, Thomas — who is one of the nine people responsible for issuing binding interpretations of the nation’s founding document — claimed that he “misunderstood the filing instructions.”

The execution of Troy Davis was delayed temporarily by the US supreme court on Wednesday night in a dramatic intervention just as he was due to be put to death by lethal injection.

The last-minute decision caused confusion outside the prison in Jackson, Georgia, where family, supporters and civil rights campaigners broke into celebration as they believed the court had granted Davis a stay of execution.

But it quickly emerged that the delay was only temporary, while the justices considered whether to issue a stay.

Until that moment it seemed almost certain that Davis would be executed, as the Georgia supreme court had rejected a last-ditch appeal by Davis's lawyers over the 1989 murder of off-duty policeman Mark MacPhail, for which Davis had been sentenced to death despite overwhelming evidence that the conviction is unreliable.

46. Still awaiting word from the Supremes. What I didn't know is
that the States don't have to wait on a Final Word from DC. They can go ahead with the execution, and that has been done previously (Rachel cited when, but it didn't stick in my mind).

The more I hear about it the more stunned I am that this would have been allowed to proceed.

And I don't know WTF is taking the Supremes so long - hell, they just have to look at a newspaper and see all the reasons to issue a Stay.

But you know something, Pat? I think with the WORLD attention to this, there's added pressure to 'do the right thing' - so I'm cautiously optimistic.

What little faith I had in our legal system is quickly being destroyed. I feel so sick and hopeless about the fate of this man. There are third world countries with more equality in their justice systems.

32. That is such good news! I was afraid I would come on DU and see that
he had been killed.

I think states should lose their rights to kill people. There is so much racial disparity and there have been so many innocent people who have been convicted (pre-DNA), that even if you believe in the death penalty you simply cannot justify its use.

45. I don't understand what happens from here. When I was at the SC
one of the organizers said the decision will be released in one week and to come back next week. I can't find any confirmation regarding timing of the decision.

This process is inhumane.
