Righthaven says it might have to file for bankruptcy
Source: Las Vegas Sun

Despite its backing by the billionaire Warren Stephens family, Las Vegas copyright lawsuit filer Righthaven LLC warned today it may have to file for bankruptcy because of a series of setbacks in its litigation campaign.

The warning came in an emergency request by Righthaven to a federal judge in Las Vegas that he stay his order that Righthaven pay $34,045 in legal fees to attorneys who successfully defended Kentucky message board poster Wayne Hoehn against a Righthaven lawsuit.

Righthaven has already appealed U.S. District Judge Philip Pro’s fee award to the 9th U.S. Circuit Court of Appeals.

Righthaven is also appealing the underlying rulings by Pro finding Righthaven lacked standing to sue Hoehn and – even if it had standing – that Hoehn was protected by fair use in posting an entire Las Vegas Review-Journal column on a sports betting website message board.

41. They'll be back under another name
but with the same basic idea, sue big message boards and hope they're cowardly enough to settle to make them go away while putting a chill on internet speech. That latter point is why Stephens backed them in the first place.

They'll be back because he won't give up.

I don't think you could label them either democrat or republican. They are still slimeballs though.

The stephens group, that backs them, donate to candidates from both parties. I guess you would have to call them republican/democrat slime, but slime nonetheless.

54. Well, I lived in arkansas (fort smith and fayetteville)
and their papers were actually more to the left than right. Conservatives think they are downright liberal papers, but that is a pretty conservative.

Off the top of my head they went after the freepers and a president of one of the tea party groups (or whatever they are called). They were after money, period.

20. I hope everyone associated with this ripoff scheme
suffers the same financial fate. In the world of 'corporate personhood,' this is the closest thing possible to 'capital punishment.' This company has proven itself unfit to exist in the same world as 'decent' companies...although 'decency' is not something I expect from corporate entities.

22. Well, no, if it was like capital punishment, the responsible parties couldn't form a new company.
It's more like a traffic ticket to a banker. What they accomplished was worth thousands of times as much as they'll lose. And everyone involved is completely free to try again, with a slightly different set of rules, until they find one they can get away with.

45. Actually what I would do is forbid the responsible managers from ever holding a management position.
No control over other employees. No control over money. No matter where they work in the future, it should be behind a service counter, like McDonalds or something.

34. What a $34,000 suit is causing them to declare bankruptcy? I call bullshit
Maybe they see that it means that future plans for these scumbags won't work, but as for that amount of money, it has to be a drop in the bucket for what these assholes have made with their litigation. All I can say is Fuck them and Fuck all of the people cheering them on as breaking new ground in the area of copyright protection.

would backfire. So this is the expected move: having caused a number of parties expensive grief defending themselves against frivolous litigation, Righthaven throws up its hands and says "Ain't got no money, honey" when they get hit with costs, and the folk behind the scheme hope to walk away scot-free

The posting of an ENTIRE column doesn't qualify as "fair use". Never has. It was a dumb thing to do.

Wasn't Wronghaven's house burned down by the fact that their business model manifestly abused the system of copyrights merely to create an income stream?
