Order signed for Sept. execution of Troy Davis
Source: Associated Press

ATLANTA (AP) — A defense attorney says Georgia is scheduling an execution later this month of an inmate who has won supporters with his claims of innocence in a 1989 police officer's slaying.

Defense attorney Brian Kammer said a judge signed an order setting an execution for Troy Davis between Sept. 21 and Sept. 28. Kammer provided a copy of the order to The Associated Press. It is the fourth time since 2007 that state officials have scheduled the Georgia inmate to die.

Davis has become a focal point for the international anti-death penalty movement, attracting high-profile figures like former President Jimmy Carter.

Davis claims he wasn't the one who killed off-duty Savannah police officer Mark MacPhail. But a federal judge rejected his claim, and the U.S. Supreme Court turned down another appeal in March.

via email:

We've just received terrible news: The state of Georgia has set Troy Davis's execution date for midnight on September 21st, just two weeks from today.

This is our justice system at its very worst, and we are alive to witness it. There is just too much doubt.

Even though seven out of nine witnesses have recanted their statements, a judge labeled his own ruling as "not ironclad" and the original prosecutor has voiced reservations about Davis's guilt, the state of Georgia is set to execute Troy anyway.

Time is running out, and this is truly Troy's last chance for life.

But through the frustration and the tears, there is one thing to remain focused on: We are now Troy Davis's only hope. And I know we won't let him down.

There are three steps you can take to help Troy:

1. Send a message of support to Troy as he fights for justice on what may be the final days of his life:

http://action.naacp.org/LettersOfSupport

2. Sign the name wall, if you haven't already. And if you have, send it to your friends and family. Each name means a more united front for justice:

http://action.naacp.org/Name-Wall

3. Make sure everyone knows about this injustice. Spread the word on Facebook and Twitter (using the hashtag #TooMuchDoubt) so that Troy Davis's story can be heard. We still have a chance to save his life, but only if people are willing to speak out against injustice.

Today, the state of Georgia has declared their intention to execute a man even though the majority of the people who put him on the row now say he is innocent and many implicate one of the other witnesses as the actual killer. Now that a date has been set, we cannot relent. We must redouble our efforts.

Thank you. Please act quickly and forward this message to all who believe the justice system defeats itself when it allows a man to be executed amid so much doubt.

6. when will there be an order to get rid of the death penalty?
sadly cases like Davis' and Kameron Todd Willingham's aren't to be taken lightly as a LIFE has been taken w/o justification, further more the 8th amendment allows for the many appeals for death row convicts, and executions are EXTREMELY rare anyway. (Speaking of Willingham, maybe Rick Perry has some explaining to do. If Mike Huckabee was soft on crime with Wayne DuMond and Maurice Clemmons, Perry is...well...)

Troy Davis Execution Set For Sept. 21

Death Penalty, Prisoners and People at Risk, USA | Posted by: Brian Evans, September 6, 2011 at 8:05 PM

An execution warrant setting Troy Davis’ execution has been signed by a Chatham County judge. The warrant sets the execution date between Sept. 21 and Sept. 28; Georgia usually tries to carry out executions on the earliest date of a warrant.

An execution is NOT inevitable. This merely sets the clemency process in motion. Before Sept. 21, the Georgia State Board of Pardons and Paroles will rule on whether Troy Davis’ sentence should be commuted, or whether the execution should be carried out as scheduled. Previously, the Board stated that it would not allow an execution unless there was “no doubt” as to guilt.

Amnesty International will call an International Day of Solidarity for Troy Davis once we know a little bit more about the plans of the Parole Board. Get started – organize for Troy now, and please check back here or at justicefortroy.org for further updates.

I've been following this case over the years. Damn that governor and that sadistic supreme court (I'm looking at you, Clarence). They're awfully cold and trigger happy and sadistic too.

If course I will sign and pass on. Poor guy! Just think if this was your brother or son.

9. I support switching it to life without parole
Edited on Wed Sep-07-11 12:49 AM by NOMOREDRUGWAR
Too many problems with the death penalty for me to be a supporter of it. But I've read about this case and I still think Mr. Davis did it and the state had a strong case against him. That said, we've executed innocent people before (Cameron Todd Willingham, for one), and I think death penalty systems lead to the very strong possibility that we'll be executing innocent people.

I'm not really impressed by the witness recantations because this is more common than people realize, but I'm open to changing my mind. If they commuted it to life without parole then he could continue to fight it out in court.

11. i'm curious ...
why do you think he did it? I've not read the case, but if the NAACP and Amnesty International are taking such a strong interest in it, there must be something that's not right about that ruling. I'm just asking out of curiosity, not challenging your opinion ....

13. Because the seven recanting witnesses
that provided such a strong circumstantial case against Mr. Davis took over 10 years to recant, did they not? That is highly suspicious and indicates that certain groups have pressured these people to recant. If they were really coerced by police into lying on the stand, then you'd think that it would either take less than 10 years for them to come forward, or that they'd never come forward. Unless someone else is willing to take responsibility for the crime, I certainly don't support paroling him.

15. I don't think that's enough reason to think he did it. But that's just my opinion.
maybe it took them 10 years to find the courage to recant.
Anyhow, the death penalty is wrong. Doubt has been cast on his guilt, and that alone should be enough to get him off death row and be granted a proper trial.

16. The death penalty isn't wrong,
but it is simply too dangerous to allow our government the power to kill people. They will inevitably kill innocents. I have no moral qualms about the death penalty, I just object to it in practice. If they somehow devised a way to ensure that we would never ever execute an innocent person, the stated support for the death penalty in this country would probably be near 85%. Many of us who oppose it do so for practical reasons, and don't like the idea of being lumped in with people who think that it is cruel and unusual punishment. It is only cruel and unusual punishment when it is done to an innocent person.

When it comes to individual cases where the accused has repeatedly proclaimed his guilt, you won't see me crying about the execution. Take Timothy McVeigh, for example. He murdered 168 innocent people, and in jailhouse interviews he explained why he did what he did. I was happy when they executed him.

Re: a new trial, only if it comes to light that the jury didn't have the evidence to sustain a guilty verdict, and in that case the courts would have to overturn the conviction.

10. totally screwed-up justice system
if they insist on something as barbaric as the death penalty, the least they could do is make sure he's guilty. those assholes can't even meet that standard.

this system is so fucked up, it's ridiculous.

14. I'm not familiar with this case.
He says he didn't do it, some people agree with him.

That's not a lot of information to go on.

I am opposed to the death penalty regardless. If Troy Davis' sentence was commuted to life without parole, there would be plenty of time to figure out whether or not he really did the crime. For now, he's been convicted therefore he's guilty in the eyes of the law.

17. via email

The day is now here - the state of Georgia has set Troy Davis' execution date for September 21st, just two weeks from today.

The U.S. Supreme Court refused to hear his final appeal earlier this year. But the story remains the same - Troy Davis could very well be innocent.

However, in the state of Georgia, the Board of Pardons & Paroles holds the keys to Troy's fate. In the days before Davis' execution, this Board will hold a final clemency hearing - a final chance to prevent Troy Davis from being executed.

Davis was convicted on the basis of witness testimony - seven of the nine original witnesses have since recanted or changed their testimony.

One witness said in a CNN news interview "If I knew then, what I know now, Troy Davis would not be on death row."

I know it's difficult to believe that a system of justice could be so terribly flawed, but keep in mind that Troy has survived three previous execution dates, because people like you kept the justice system in check!

We've been bracing for this moment and the time for action is now! Here's what you can do to join the fight:

Sign our petition to the Board of Pardons & Paroles urging them to grant clemency! We'll deliver your signatures next week.
Organize locally for Troy: Take to the streets with us. Soon we'll be announcing the date for the official Troy Davis Day of Action. Sign up now to rally in the coming days to stop the execution of Troy Davis.
Tell everyone you know! Spread the word about this injustice on Twitter by using the hashtag #TooMuchDoubt. Be sure to tell your Facebook friends Troy's story too!
Thank you for fighting for Troy,
