Journal SentinalState won't appeal restraining order on collective bargaining limits
Madison -- The Department of Justice will not appeal a temporary restraining order barring the state from implementing a controversial measure to limit collective bargaining for state employees.
"Because the legislative defendants have constitutional immunity which they are not required to waive, no appeal will be filed on their behalf," said a statement from department spokesman Bill Cosh. "The matter has been placed before the Supreme Court by the Department of Administration and Secretary (Mike) Huebsch and we look forward to letting that process play out."
The Department of Justice this week sent a letter to the Supreme Court that noted Thursday was the last day it could appeal the restraining order. The justices have not said whether it will take up the case.
Lawmakers are immune from civil process during the legislative session, and the four Republican leaders accused of violating the open meetings law would have to waive that immunity to appeal.
