Judge says federal law bars lawsuits over vaccine side effects; infant, now 19, suffered seizures after receiving DPT shot

The Supreme Court ruled Tuesday that a federal law bars lawsuits against drug makers over serious side effects from childhood vaccines.

By a 6-2 vote Tuesday, the court ruled against the parents of a child who sued the drug maker Wyeth in Pennsylvania state court for the health problems they say their daughter, now 19, suffered from a vaccine she received in infancy.

Justices Ruth Bader Ginsburg and Sonia Sotomayor dissented. Nothing in the 1986 law "remotely suggests that Congress intended such a result," Sotomayor wrote, taking issue with Scalia.

Justice Elena Kagan took no part in the case because she worked on it while serving in the Justice Department.

1. This is the kind of thing that points up why
we need universal health care like other civilized countries.

No matter what the real underlying cause of that child's seizures, no matter what screw-up a hospital or doctor makes, if everything were paid for there would be far fewer lawsuits.

I understand the part about punitive damages tending to make the wrong-doers change their ways. But just imagine what life would be like if we never had to wonder if we'd be able to pay for any of our health care?
