Marshall seeks to ban gays from Virginia National Guard

Following this weekend's vote by the Senate to allow gays to openly serve in the military, Del. Bob Marshall (R-Prince WIlliam) said he is drafting a bill for the 2011 legislative session that would ban them from serving in the Virginia National Guard.

"This policy will weaken military recruitment and retention, and will increase pressure for a military draft,'' Marshall said. "After 232 years of prohibiting active, open homosexuals from enlisting in our military, President Obama and a majority in Congress are conducting a social experiment with our troops and our national security...In countries where religions and cultures find homosexual acts immoral, the Obama administration's repeal policy will work to the detriment of all American troops in securing local cooperation with our nation's foreign policy goals."

The Senate's vote to repeal the 17-year-old federal ''don't ask, don't tell' policy came a week after the House approved it. President Obama has said he will sign the bill.

Marshall, who is considering running for U.S. Senate in 2012, is one of the House's most conservative members. He said Article 1, Section 8, Clause 16 of the Constitution gives Virginia the authority to uphold the ban by "reserving to the states respectively, the appointment of the officers, and the authority of training the militia according to the discipline prescribed by Congress."

The feds pay the states big bucks to organize their guards the way the feds want. The feds write the rules because they pay the bills.

will make their stand. I expect some turmoil, both within the Armed Services and from without, mostly inspired by angry rants from armchair warriors. This too shall pass, and we shall be better for casting it aside.

ultimately, the National Guard falls under federal regulations and laws. This will go nowhere once it is brought up that federal funding to maintain the NG for the state will dry up. VA cannot afford to fund the VaNG on it's own, not to mention that it is illegal to do so, since they can be federalized at any time. This is insanity at it's best and should cost this idiot his job.

14. This is Palin-esque logic; when she claimed she was the "commander" of the AKNG
and she is not. a Brigadier General is in command of each state. The governor can authorize FUNDING to deploy NG into the state...But that 1 star still wears a US ARMY uniform.

Rep. Marshall went right past this:
Article 1, Section 8, Clause 15
To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;
So shall we call forth the Militia to suppress Mr. Marshall's insurrection?

No need:
Since the Militia Act of 1903 all National Guard soldiers have held dual status: as National Guardsmen under the authority of the governor of their state and as a reserve of the U.S. Army under the authority of the President.

The Commander and Chief trumps Gov. Ken Cuccinelli. Unless Marshall and Cuccinelli want to pony up the money for their own State Militia, they can just STFU. The fact is that the National Guard AND their posts within every state are U.S. Army/Air Force property, to be ruled and used as the Commander and Chief sees fit.

Virginia Gov. Bob McDonnell (R) said through a spokesman late Monday that he opposes Congress's repeal of the military's "don't ask, don't tell" policy but expects to allow gays to openly serve in the Virginia National Guard.

The remarks came after Del. Bob Marshall (R-Prince WIlliam) said he is drafting a bill for the 2011 legislative session that would ban gays from openly serving in the Virginia National Guard.

A state lawmaker from Virginia is so upset about the Congress repealing Don't Ask, Don't Tell that he wants to institute a mini-DADT banning gay men and lesbians from the Virginia National Guard.

"It's a distraction when I'm on the battlefield and have to concentrate on the enemy 600 yards away and I'm worried about this guy whose got eyes on me," the lawmaker, Delegate Bob Marshall (R), told WUSA9. "If I needed a blood transfusion and the guy next to me had committed sodomy 14 times in the last month I'd be worried."

Marshall says he's working on legislation to institute a DADT-style state law. His authority to do so, he claims, comes from the clause of the U.S. Constitution which reads, "reserving to the states respectively, the appointment of the officers, and the authority of training the militia."

But Virginia Gov. Bob McDonnell (R), who has the authority to deploy the state National Guard in a state emergency, says no way.

"Whatever the final guidelines are from the Department of the Defense, I expect the Virginia National Guard Bureau to adhere to them," McDonnell said during a WTOP radio show today.
