Meg Whitman says she would defend Proposition 8

Republican gubernatorial candidate Meg Whitman said this afternoon that if elected governor, she would defend Proposition 8, which prohibits same-sex marriage, by appealing a recent federal court ruling declaring the proposition unconstitutional.

Whitman made her clearest stand to date on the issue while speaking at the warehouse of Solar Gard Window Film in San Diego, hours before she's scheduled to address the California Republican Party's convention downtown.

During a brief news conference, the Bee asked Whitman whether she would defend Proposition 8 if elected governor. The 9th U.S. Circuit Court of Appeals has taken up the issue after Chief Judge Vaughn Walker of the U.S. District Court of Northern California declared the measure unconstitutional earlier this month.

"The issue right now is, as I understand is 'Will Proposition 8 have the appropriate support to actually make an appeal to the circuit court of appeals?' " Whitman said. "And I think the governor, the attorney general today has to defend the constitution and has to enable the judicial process to go along and has to enable an appeal to go through. So if I was governor, I would give that ruling standing to be able to appeal to the circuit court."

4. Her answer makes no sense! Sounds like she doesn't know what she's
talking about. She doesn't seem to understand the judicial system. I hope she loses by a landslide (please oh please). We here in CA don't need her messing up CA anymore than it already is!

6. I believe she's referring to the standing issue.
With the Prop 8 appeal, the judge ruled that the Prop 8 campaign had no standing to appeal, because they couldn't prove harm. He reasoned that the only parties with standing to appeal would be CA state officials charged with enforcing his original ruling. If Whitman manages to win, she would then apparently be able to appeal the ruling.

I don't agree with her, but I believe that's her reasoning here. Still, it's not entirely clear whether the 9th Appeals court will accept the judge's argument regarding standing.

As Governor she would have "standing" to defend prop 8. All they have to do is drag this out until Nutmeg gets sworn in.

what she is talking about ! I just cant believe the people of CA. and them always voting in these repuk govenors. If you look at the list of them its an insult to our intelligence here in Ca. that we let these people convince us they are good for this state.The first one that comes to mind is Reagan !

8. She's being pressured by one wing of the Republicans.
She's being pressured by the ultra far right wing to take a firm stand, threatening not to back her in the general election fully unless she complies. The other wing, the far right, is not so concerned.

So much for her independence. Self vaunted independence.

12. Actually Boys and Girls this is NOT good. Remember that--
Prop. 8 Appeal isn't till December. And one of the hurtles that the bad guys have to vault is whether they can appeal it because they're NOT the State of California. That is the Governor. Gov. Arnold has not seen fit to defend Prop. 8, and this is to the benefit of all anti-prop-8 folk. Now there's some possibility that even if Meg wins the arguing side will won't have a leg to stand on.

BUT if she does win, and is going to become Gov. in January, then the pro-8 folk just have to drag out that appeals process till new Gov. Meg is in office. She will then say, "Why, yes, California wants to appeal that anti-prop 8 ruling." This doesn't mean California will win the appeal, but it would be so much better with Gov. Brown saying, "Don't know who those guys are arguing the appeal, but they're not the State of California."

The best thing that could have happened didn't, of course, which would have been the court not agreeing to a stay or to hear the appeal. But there we go. If Meg wins, the battle over Prop. 8 is that much more in danger of continuing.

26. Welcome to DU, and to expand on what you said

This helps Whitman's standing with Californian conservatives(I live in one of the most conservative counties in CA). There was an article in my local paper yesterday about how conservatives were not happy with Whitman because she didn't support AZ type immigration laws. She understands how important illegals are to CA's agricultural industry.

She just zeroed it out by coming out and supporting Prop 8.

However, this will also affect Independents towards her. A lot of Independents in the state want AZ type laws, but they're strongly against Prop 8 so the total effect is unknown.

17. I think she would be outside the time limits for appeal.
Notice of appeal has to be given to the Ninth Circuit within 30 of the final order of the district court. If elected she would not take office until January. The Ninth circuit can extend that to 180 days if the court finds that no party would be prejudiced. I doubt the court would let her appeal at that late date.
