Sheriff Arpaio Will Not Turn Over Records To Feds

PHOENIX -- An attorney for Maricopa Sheriff Joe Arpaio said the sheriff does not plan to meet the Department of Justice’s Aug. 17 deadline for turning over records related to a civil rights investigation.

Robert Driscoll said the DOJ’s request is too broad.

Driscoll said he will meet with DOJ attorneys next week to discuss the records request.

The Department of Justice has asked the sheriff to turn over records related to their investigation since March 2009.

Earlier this month, DOJ officials sent a letter saying they would sue Maricopa County if the sheriff failed.

County officials have expressed concern the federal government will withhold funding from Maricopa County as a result of the sheriff’s actions.

24. Contempt of DOJ? Nothing wrong with that. Different story however
if DOJ gets a court to transform the DOJ "request" into a court order. Then he would have a legal duty to comply.

But voluntarily give anything to DOJ or the FBI? Ask Blago (or Scooter) how safe it is to even talk to them. LOL

3. Certainly not defensive of this offensive SOB...
This type of non compliance isn't uncommon between state and federal agencies, it actually happens a lot. A prime example is the feds refusal to appear, even under court order, for state prosecutions.

I should clarify, it has always been federal leos...fbi, dea, etc. Their supervisor will write a letter to the judge explaining that an appearance would jeopardize an ongoing investigation, then a cite of some obscure SCOTUS ruling which allows the leo to disregard a state subpoena if it interferes with an ongoing investigation. I can think of two cases which the feds refusal to testify resulted in acquittal of a person who I believed strongly was guilty. I have personally served state subpoenas on 8 or 10 fed leos and not one has actually appeared to testify.

Further one of the cases which the accused walked was a minor raped by a federal informant and the informant's handler knew that the rape occurred...no testimony, no case, minor's rapist acquitted...nice..

Why no indication of what the sheriffs "side of the story" is?

did they even try?

No phone call asking "Sheriff Arpaio, why are you refusing to honor the subpeona or turn over the requested records?"?

and then if no response or a no comment then a line in the story saying so....
