FCC's Powell Questions Indecency Bills' Constitutionality and (drumroll)
... Seeks FCC Authority To Regulate Cable!

But the bill also ... would regulate violence on cable and satellite television if a study showed that so-called v-chips in televisions aren't effective in screening out violence.

While the FCC has clear authority to regulate broadcast indecency, its reach to cable is tenuous at best. And Mr. Powell said the agency needs clear authority from Congress to regulate violent content on cable.

3. This bill is the one that rolls back Powell's pro-conglomeration rules.

...
the bill also included a controversial provision to roll back the FCC's June 2003 media-ownership deregulation rules
...

This part of the bill is a good thing. And contrary to the article's editorializing, this part of the bill is supported by a supermajority of Americans.

5. This is all about political leverage.
Once they're given this power, they will use it to pick on their few political opponents that are left in the media. That's all this is about. They want to be able to threaten a witchhunt against anybody that doesn't toe the right-wing line. They will not use this against all offenders- only those who oppose them politically.

6. Regulate Ownership -- not speech
The FCC gets their authority under the Commerce Committee.

Therefore, they should regulate ownership -- owners should be regional, and not monopolies. Then we would truly have "community standards" and there would be no reason to regulate speech. This should not be part of their mission.

Otherwise, we put the judgement of "serious literary, political, artistic or social value" to people like Antonin Scalia. Scary, eh?

If thine TV offends thee -- turn it off!
