Connie Rhodes says she or others shouldn't have to go to war until Obama's legitimacy is proven

An Army captain fighting deployment to Afghanistan has challenged the legitimacy of Barack Obama’s presidency in a federal complaint filed this month, and has employed attorney Orly Taitz — a national figure in the “birther” movement — to represent her.

The complaint of Capt. Connie Rhodes, filed Friday in the Columbus division of U.S. District Court, is similar to the July 8 suit filed by Maj. Stefan Frederick Cook, who sought conscientious objector status and a temporary injunction. Taitz represents both.

Judge Clay Land, who will hear Rhodes’ case, tossed out Cook’s case in July. Land said the judicial branch shouldn’t inject itself into “political disputes” and shouldn’t get involved in hypothetical debates that haven’t yet become actual legal disputes.

The Rhodes complaint makes similar arguments.

“Plaintiff ... submits and charges that the current de facto president is an illegal usurper, an unlawful pretender, an unqualified imposter ...” the complaint states. “(She) submits that she cannot lawfully act under his authority, but that she is being forced to do so without any opportunity or remedial avenue whatsoever.”

1. Doesn't Capt. Rhodes know that Major Cook lost his job from this stunt?
Good luck, and may I suggest retaining a real lawyer for your wrongful termination lawsuit.

It's an approach doomed to failure, but there is pretrial delays, delays during trial, and then delays preparing for appeals etc., etc. etc.

If you can live in limbo this IS a short to medium term tactice that _can_ work as long as your case maintains standing in some crazy judges court somewhere.

2. How stupid can she be?
Cook pulled this same stunt and now he doesn't have a job. When her case is thrown out, Captain Rhodes is looking at a possible courts martial for refusing to obey a direct order, missing movement, and contemptuous language directed against the President.

Personally as a former soldier and NCO I hope they burn her at the stake. In my opinion she's using this ploy to hide her own cowardice.

And it seems that while she only took the California Bar exam and can freely practice law in that state, Orly Taitz can also present cases in federal court as well.

5. So I guess she disobeyed her order to report on August 30th.
As well as her order to deploy on September 5th. And I don't think she got permission to do so. Assuming I'm right, any word about the Army's reaction, if any?

I'm guessing she's trying to get out of a service obligation related to educational support. And I think she's going to get more than she bargained for once the UCMJ is unleashed.

6. Got news for Captain Rhodes, she disobeyed her orders, which did not come from the POTUS.
They came from the DOD. Now shut your pie hole and brush up on some Farsi, and that is an order! Did she think she was going to stay in the Rhineland forever? Sorry, hon, it ain't always the Biergarten nightly on overseas duty.

Early summer 2008 she forged another doctors signature on her own medical profile to get out of taking a PT test.
Fall 2008 she helped create a fraudulent military document to convince a man's wife he needed to fly to Georgia for a military hearing. He flew to GA and never returned to his wife in Texas.

Rhodes' family went to Kansas to begin school in August 2008. Rhodes was to join them in November. However, as mentioned above, she had another man move in with her and ultimately brought him with her when she came to Kansas. Making this worse, since the military was going to move everything in November, her family merely took a couple suitcases with them and were renting a single room from another family, waiting for her to arrive at which time they would move into a house together. She has deprived her husband and her stepdaughter of all their personal belongings(even the childs toys, etc) for over a year now.

She tricked her husband into removing her name from the credit cards on the premise it would help her more easily finance the family home in KS. She did this only 2 weeks before leaving him.

She has provided no support to them for over a year. Yet, has continued to have 2 dependents listed with the Army throughout, receiving extra compensation. Compounding the unfairness of this is her husband put off his education for 4 years and worked full time to support the family while she went to medical school with the understanding she would support the family after she graduated, so he could resume school. She decided to just walk away. As she is trying to do from her pledge to the Army.

Coups are done by Colonels NOT Captains and NEVER anyone from the Medical Corps. That is NOT the smell of a coup, it is the smell of horse-shit. If the Colonels thought something was wrong you would be hearing from them, but I have heard nothing. The Colonels are much more worried about their 20 years in and a nice pension NOT overthrowing an elected President (When NOT worrying about the War in Iraq, Afghanistan, other hot spots and what are they going to do when they retire).
