New York AG Says Gays Will Win Marriage War As New Paltz Mayor Charged

New York Attorney General Eliot Spitzer says he decided not to fight gay marriages being performed in a small village north of Manhattan because it is a case the state can't win.

"We wouldn't have won," says Spitzer. The state, he says would have been unable to prove that there was any "irreparable harm" against any party - the standard needed to persuade a court to grant an injunction.

"I have no problem with gay marriage," Spitzer, a Democrat, says. "I think the law has moved to a point where people are comfortable that can be extended to people of the same sex."

Nevertheless he said many state legislators and even some in his own office disagree. As a result he has ordered a complete review of the state Constitution to determine whether civil marriages between same-sex couples are already legal.

Ultimately, he says, "the courts are going to have the final say."

not to mention just having his support is incredible. The temptation to break all the LBN rules re: excessive punctuation was almost unbearable.

3. Draft Spitzer for president?
It's true, he could have pushed much harder on the corporate crime wave. But he is nearly alone in the Democratic Party as someone who has actually done something about it.

Plus, he's simply sensible and sounds like a human being. Would that he were the nominee!

5. Of course us queers...
...are going to win this war. We want the rights that are meant to be given to us, just like the U.S. constitution says. What they wan't to do is go against the constitution. The repukes are on a losing battle with this one.

I hope more people will start realizing this. Protecting the civil rights of any group help protect the civil rights and freedoms of all.
