Bernard Madoff Prosecutors Ask U.S. Judge to Jail Him

"Bernard Madoff mailed additional jewelry, including Cartier and Tiffany watches, a ring, a diamond bracelet and diamond necklace, prosecutors said in a letter expanding on their request to jail the investment adviser for violating the terms of his bail.

Assistant U.S. Attorney Marc Litt in Manhattan sent a letter to U.S. Magistrate Judge Ronald Ellis yesterday asking that Madoff be imprisoned for transferring more than $1 million in possessions. The letter, made public today, broadens the grounds for the request Litt made in Manhattan federal court Jan. 5.

The letter contains new details about the items Madoff mailed to friends and relatives in separate packages. One of them contained 13 watches, a diamond necklace, an emerald ring, and two sets of cufflinks, the collective value of which may exceed $1 million, Litt said.

“Two other packages -- containing a diamond bracelet, a gold watch, a diamond Cartier watch, a diamond Tiffany watch, four diamond brooches, a jade necklace, and other assorted jewelry, also were sent to relatives,” Litt wrote. He said prosecutors have recovered those items. Two other packages were mailed by Madoff or his wife to Madoff’s brother Peter and an unidentified couple in Florida, the prosecutor said."

8. Refresh my memory - if
if an accused dies before conviction, then plaintiffs can not fully recover from the decedent's estate, is that correct?

13. Pretty sure it's between conviction and sentencing.
I'm not a lawyer. That's just the back of the memory module from the Ken Lay situation.

14. IANAL, but....
Lay died of a heart attack July 5, before he could exercise his right to appeal. As is customary in such instances, the court vacated Lay's criminal conviction. This immediately freed Lay's estate from attempts by Lay's victims (i.e., Enron stockholders and employees) to recover their losses via the U.S. justice department. There may still be civil penalties against her husband's estate by the SEC, but Lay's widow, Linda Lay, will not have to pay restitution.

16. In CRIMINAL matters, yes, but in CIVIL LAWSUITS NO.
In Criminal Actions the defendant has the right to defend himself as to the CRIMINAL CHARGE, if he is no longer alive how can he defend himself? In Civil lawsuits the issue is liability and if the defendant dies before the trial is ended, he loses the ability to defend himself, his estate can defend for him. The Courts look at Civil Lawsuits as mere money and as such awarding judgments against the Defendant is not view in the same light as taking away someone's liberty, which can be the result of any criminal action.

What kind of fool pulls a stunt like that? He was supposed to stage a burglary and make an insurance claim. That is how sensible people do it.

"The lawyer has said that Madoff’s transfer of jewelry was an innocent mistake and that Madoff and his wife are in the process of retrieving the items from his sons, other relatives, and acquaintances"





I bet that $1 Million could be given to the low guy's in this fraud & save a few families life
