Congressman's Suit Seeking Voting Machine Paper Trail Dismissed

WEST PALM BEACH, Fla. (AP) - A congressman's lawsuit seeking that electronic voting machines be required to produce a paper trail was dismissed Wednesday when a Palm Beach County judge ruled he did not have the standing to sue.
U.S. Rep. Robert Wexler, D-Boca Raton, filed the lawsuit against Florida Secretary of State Glenda Hood and Palm Beach County Supervisor of Elections Theresa LePore, claiming the use of machines that do not produce paper duplicates of the votes cast violates voters' rights.

Without that paper trail, a manual recount isn't possible, Wexler argued.

But Circuit Judge Karen Miller ruled that without proof Wexler, as a citizen or a public official, had been hurt by the voting system, he didn't have standing to file the suit. Moreover, Wexler's complaints would be better addressed through legislative remedies, her order said....cont'd

1. That's almost funny.............coming from Florida.

After 2000, when sooooooooooo many voters' rights were violated, Judge Karen Miller decides this is a non-issue? This from the state that purged close to 50,000 voters from it's roster in 2000. In a state that looks as if it's going to be another nail biter this fall, we wouldn't want anything keeping the totals honest, now would we?

2. We're all going to suffer several Republican misadministrations if
we wait for legislative remedies. The only true way to change anything in Florida is through referendum. Let the people change the constitution. And they need to do it quickly before the legislature makes it more difficult to do -- if they haven't already.

3. This is ridiculous!
I'm not surprised to see judges on diebold's side. I hope Wexler doesn't give up and maybe a class action suit can be organized. It wouldn't be hard to prove that as a result of Florida's messed up voting systems the entire Country has been seriously harmed.
