Judge Rodney Steele has handed down a sentence for former Congressman Bill Janklow. Janklow has been sentenced to 100 days in the Minnehaha County Detention Center. After 30 days, he will be allowed to finish that time by doing community service.
Judge Steele also fined Janklow $5,000 and repay Moody County $50 a day for the cost of his 100 days in jail. Janklow was ordered to report to the Minnehaha County jail in Sioux Falls on February seventh to begin his sentence.
Janklow will also spend three years on probation. During that time, he will not be allowed to drive. There are also other restrictions under the probation. Janklow will be fined $5,000.

They were saying that after 30 days, he could be out 10 hours a day, 6 days a week to do community service.

Way the hell too short a sentence for what he did, but he isn't free after 30 days.

People who are convicted of non violent drug charges get 20 years,
yet he kills someone and gets 100 days.

That is outrageous, let's see what O'Reilly and Hannity say about this. Will

Former South Dakota Congressman Bill Janklow will serve 100 days in jail, pay a fine and lose his driving privileges for three years while he's on probation for a fatal accident. But Judge Rodney Steele suspended a prison sentence against the former congressman and governor for a manslaughter conviction that killed motorcyclist Randy Scott. If Janklow abides by the conditions and obeys the law, his record will be cleared. After 30 days, Janklow will be allowed to leave the jail six days a week for up to ten hours a day to do community service. Judge Steele also fined Janklow five-thousand dollars and ordered him to repay Moody County 50 dollars a day for the cost of his 100 days in jail. 21. He won't do all 100 days
they get good time and work time in county jail. I don't know what it is in his state, but generally they automatically get 30-50% off the actual days sentenced for these credits. So when he is off doing community service he gets credits towards his work time.

The fact of the matter is that here in the Heartland a very, very large percentage of people "habitually speed." No, that doesn't make it right. And no, that doesn't mean we shouldn't be held responsible for our conduct.

But under a properly functioning criminal justice system, it's the conduct, not the outcome, that should form the primary basis for assessing the punishment. It's referred to as the element of "blameworthiness."

Let's take a different example -- assume a no name nobody is driving to the store, becomes distracted, and blows through an intersection. Has it ever happened to you? It sure as hell has to me -- and I consider myself to be a safe driver. Now, let's assume that our hypothetical normally safe driver is unlucky: He plows into someone killing them. Is he really more blameworthy than you or me? Don't get me wrong: Consequences do come into play and what would have been a traffic ticket now becomes a serious crime. But in assessing the punishment for that crime it's primarily the act itself that should be weighed. Civil trials are to compensate injured people (such as the heirs of the victim in Janklow's case). Criminal trials are primarily to punish the conduct.

Is 100 days too little in this case given his history? Probably. But this business of it should have been 10 years or even 100 years is also wrong. Part of being a liberal to me means opposing the idea that lengthy imprisonment should be imposed just to make people feel good. And yes, it's a disgrace that minor drug charges bring much longer sentences, but the remedy there is to change the law, not to extend the stupidity to other situations.

that he used to laugh about....that he lied to police about how the accident happened and that he went 70 mph THROUGH A STOP SIGN.

Remind me not to drive in that state if that is the way the citizens there feel about negligent homicide.

Now, in a more general response to the preceding posts, by what warped concept of speech was I "defending the guy?" I specifically said the jail term was probably too light.

Did he rape an Indian girl? Damned if I know. And by the way, damned if you know, too. What I do know is that isn't what he was charged with. Come on folks, let's try to exercise a tad less hypocrisy than the other side. Whether you like it or not, the sentence isn't terribly out of line with other non-alcohol related negligent homicide cases.

Most speeders are safe and attentive.

Janklow WAS NOT safe and attentive.

What's worse, he made up a story about a mysterious white car that appeared out of nowhere.

When it was discovered that was bullshit he made up another story about not eating all day.

That story too turned out to be a lie, because as a very fat man with diabetes, he would have died from "forgetting" to eat.

People going 10-15 over the limit in a flat straight road with no traffic, it's not so bad. Blowing through a stop sign and then making up two equally rediculous stories to cover it up, THAT'S what the problem was. That's why stop signs exist!

200 days behind bars for manslaughter, rape and murder. That'll teach those law-braking Republicans!

It would be interesting to know what the typical sentence for similar cases is. I don't agree that ten years would be too much for this jackal. The law is partly about punishment, but it's also about setting an example, and Janklow has been one Hell of an example.

From the Argus Leader 1/18/04

What is certain is that in the past 15 years, 40 people in South Dakota have been convicted of or pleaded guilty to second-degree man-slaughter. The maximum term in prison is 10 years.

Of those 40 people:

• 32 were sent to prison or jail. The average prison term was seven years. The average jail term was six months.

• Seven received probation and spent no time behind bars.

• And one was given a suspended prison sentence because he was in federal prison at the time for another crime.

I got 14 days in jail and 45 days in an alcohol rehab for breaking a car window, class B felony that stuck. Fuck this country!

And they were very smart--filed it in Minnesota, not South Dakota.

... "The Associated Press has confirmed that the family of Randy Scott has filed a wrongful death lawsuit against Bill Janklow in civil court in the Twin Cities. Janklow resigned from Congress yesterday and will be sentenced tomorrow. Janklow's lawyer, Ed Evans, would not comment.

Lawyer Ronald Meshbesher represent Scott's two children, mother and sister and says the former congressman was served with the papers on Friday at the Minneapolis airport. Scott died August 16th when Janklow ran a stop sign near Trent.

Meshbesher says he'll oppose any attempt to make the federal government cover the damages because he doesn't believe Janklow was on official business."...

If you want to kill someone in cold blood in our state and
get away with it, you just have to use a car.

Disgust... All I can say is that if the conceal carry law does go through, I am going to ride my bike with a big ass gun. The next person to assault me with a car after that will get a permanent license suspension from Smith and Wesson.

He gets drunk, kills a man, and only gets a slap on the wrist for it????? That's insane!!!!! He should be in jail for at least 20 years!!!! This is an outrage!

Shows how flawed our legal system is! This man kills a guy and goes to jail for 100 days. Another guy can do drugs and stay in prison for five years! What a joke!

Was he proven to be drunk? If he is a diabetic...he really can't drink liquer...it will kill him...eventually...or sooner.
If he was drunk he should have gotten 5 years in the can. If sober 3 years...followed by community service and restitution to the family.

Such a sad, sad story. When I was young I used to ride bikes. I was hit by cars twice, over the years. After the second time, I quit riding.
Suffice to say being hit by a car running a stop sign is a real bitch. I flew up in the air cartwheeling head over heels and the impact actually knocked my shoes right off my feet (just like in the cartoons). When the ambulance arrived they just scooped me up off the asphalt and scooted me off to the emergancy room. One year later I was good as new.
The guy who blew the stop sign...sent me flowers.
