Judge Seems Wary of Opening CIA Inquiry

WASHINGTON (AP) - A federal judge appeared reluctant Friday to investigate the destruction of CIA interrogation videotapes while the Justice Department is conducting its own inquiry.

U.S. District Judge Henry H. Kennedy is considering whether to delve into the matter and, if so, how deeply. The Bush administration is urging him to back off while it investigates.

"Why should the court not permit the Department of Justice to do just that?" Kennedy asked at a court hearing Friday.

More likely, he wants investigations to go according to the law. And without looking at any extenuating circumstances, it should be up to the DoJ to do the investigation (I realize, of course, that due to the corruption of the DoJ, that's a problem, but said corruption doesn't have any bearing, legally, on the situation at hand).

I think this is less a judge who has been gotten to and more a case of a judge following the letter of the law regardless of the damage that may do.

By the way, it's worth noting that Kennedy is a Clinton appointee, and that his very original ruling in this case -- that no evidence of torture at Guantanamo can be destroyed -- is certainly a mark in his favor.

4. Maybe he's simply asking the detainees' lawyers for a reason.
And maybe if they give him a reasonable one he'll accept it. I don't think that the fact that he's asking the question necessarily indicates that he is "wary". Phrases like "seems wary" and "appeared reluctant" are completely subjective and may simply be media spin.

A very specific federal court order has been intentionally violated, and he is going to do nothing? You have to be fucking kidding me.

This case isn't about the criminal "Justice" department. It is about evidence of a man's liberty being illegally deprived.

The question is "Why in the fuck should a person whose liberty has been illegally usurped have to wait on the god damn criminal justice department?"
