Reuters: Judge dismisses Cuban militant Posada's claims
Judge dismisses Cuban militant Posada's claims

Reuters
Wednesday, February 21, 2007; 5:10 PM

HOUSTON (Reuters) - A U.S. judge in El Paso on Wednesday dismissed
demands that U.S. immigration authorities release an anti-Fidel Castro
militant accused of bombing a Cuban airliner in 1976.

The decision had been expected since Luis Posada Carriles was indicted
January 11 on criminal charges he lied to immigration officials. He is no
longer in immigration custody pending deportation, but is in jail
awaiting trial.

"The court finds that it cannot grant petitioner his requested relief as
petitioner is no longer in the custody of the Department of Homeland
Security," U.S. District Judge Philip Martinez of El Paso wrote.

1. Super! The Washington Post describes the bombing/mass murder or men, women, and children as
"working against Castro" by someone who "was at one time in the pay of the CIA."

Washington Post, a man who slaughters people, and bombs and kills people in Cuba's hotels, restaurants, discos is not "working against Castro." He is "working for the Cuban radical right-wing reactionaries," and associated right-wing vampires in the States.

Posada, it's time to go to Plan B: threaten to go to the newspapers with your story about the years you have worked for the C.I.A., and in Iran-Contra, and your years of living with no visible source of income. Oh, yeah, I forgot some jerk in Miami is selling what he claims are painting you have done over the years, as Posada the Painter. Riiiiight.

2. Posada paints with children's blood.
Edited on Wed Feb-21-07 07:32 PM by Mika
The case has become a cause celebre pitting anti-Castro Cuban Americans who consider Posada, 78, a freedom fighter, against Cuba and Venezuela, who have demanded his extradition as a terrorist.

A cause celebre??!! Over a bloodsoaked murderer of children?

More like a cause macabre. Fitting for the Batistano gusanos.

A "cause celebre" that Ileana Ros Lehtinen campaigned on in her 1989 election campaign in S Florida. "FREE POSADA" was one of her public slogans and campaign posters handed out in Miami Dade appearances.

She won, and has since.

This is her, "representing" her base --> -YouTube video here-

3. Why the Bush Administration won't extradite Posada or try as a terrorist:
http://www.washingtonpost.com/wp-dyn/content/article/2007/02/21/AR2007022101431.html">More from the WP:

.....

The case is embarrassing to the U.S. government, engaged in a war on terror, because Posada, who for years worked against Castro, was at one time in the pay of the CIA.
Cuba and Venezuela argue Posada must be turned over to face charges in the airliner bombing, in which 73 people died, but U.S. officials have refused, arguing he might be tortured.
At the same time, the United States has refused to allow Posada, who sneaked into the country in 2005, to join relatives in Miami, Florida. He has said he has renounced violence and only wants to be with his family.

The United States has not been able to find another country willing to accept Posada's deportation, and a judge said in November he either had to be charged with something by February 1 or released.

U.S. officials had resisted either course until recently.

An indictment returned by a grand jury in El Paso on January 11 accused Posada of lying about how he entered the United States and making false claims on a naturalization application. He could face 40 years in prison if convicted.

* is harboring this terrorist, threatening him with a 40-year sentence for making false claims on a naturalization application :eyes: because if he is extradited, this guy just might *talk* about how he worked for Poppy's CIA buddies all those years ago. Wouldn't be prudent.

According to Prensa Latina on January 24, 2007:

Havana, Jan 24 (Prensa Latina) The notorious terrorists Luis Posada Carriles and Orlando Bosch are passing the bill for compensations of services to the US government and intelligence community.

Posada Carriles, a protegee of the US for many years, seems upset after criticism from Cuba, Venezuela and regional organizations forced him to go to trial, even for petty crimes.
There is no mention of his murderous record, including the 1976 mid-flight blast of a Cuban commercial plane with 73 people aboard, the bombing of hotels in Havana or the torture and murder cases in Venezuela, and he dared to plead "not guilty" to emigration violations.

The Nuevo Herald of Miami said his business partner, terrorist Orlando Bosch, wants to get in on the action, with hints of threats to "friends" in the government.

Bosch lashed at the Administration for trying Posada and recalled their important services to the CIA and contribution to US plans against Cuba and other Latin American countries.

Bosch threatened to expose some secrets if their peaceful lives are disturbed, which explains their current status, the US refusals to extradite Posada to Venezuela or try him as an international terrorist.

Sure sounds like Posada/Bosch are resorting to blackmail aimed at the * Administration for "services rendered".... This could get very illuminating. Wonder what Poppy thinks about all this?

4. Judge Dismisses Posada's Bid to Be Freed (AP)
By ALICIA A. CALDWELL
Associated Press Writer

EL PASO, Texas | A federal judge on Wednesday denied a request by an anti-Fidel Castro activist to be released from jail while immigration officials figure out where to deport him to ...

Posada, an ex-CIA operative who is suspected of bombing a Cuban jet 31 years ago, left Department of Homeland Security custody after his indictment last month on suspicion of lying in a citizenship application.

Posada, 79, was arrested two years ago on an immigration violation after he reported paying a smuggler to sneak him into Texas from Mexico ...

Several countries, including Mexico, have declined to allow Posada in. He sued last year, arguing that the U.S. government cannot hold him indefinitely while they look for a country willing to let him move there ...

5. He's had 30 years of freedom for that one act, but he was a terrorist
before and after the bombing of kids and other passengers.

He is a protected terrorist. He was probably told - just lie a little and we'll protect you on this one also.

Killers within the CIA should also be tried.

I wonder how many hate and revenge filled Cubans have worked for the CIA for as man decades as he has.

afters all that hate, after all that effort, Castro is living out a life of ordinary helath problems and discomforts of old age. As is Posada Carilles.

Their war of hate was about as value filled as the war in Iraq and the war in Vietnam. But his territory was Cuba, Central America, Venezuela, Panama, Central American. Africa?

All those tough guys are old now. What a waste.

Now, reread the title on this article:

"Judge dismisses Cuban militant Posada's claims"

Militant - my how nice. Hear this WP: He is a T E R R O R I S T!!!!! He has lived a life of terrorism. He is a PROTECTED TERRORIST. Paint that any which way you want, but he's still a terrorist, supported by many Cuban-Americans as a brave crusader.

6. I wish Cuba would arrest Osama bin Laden.
No, I don't want to see Osama go free -- but a lot of attitudes in this country might change if roles were reversed.

(Not to mention an inherent love of irony and poetic justice)

10. It is precisely this
sort of case that helps substantiate Cuban government claims about US terrorism against the Cuban nation. If the authorities in the US would do the right thing with such terrorists, such as allowing extradition to stand trial, instead of trying to either re-employ them or give them positions in Republican administrations, as they have done with Orlando Bosch, the image of the US would improve drastically and the people of Cuba would have a reason to believe US claims that America is working to help "establish democracy" (albeit US-style corporatist democracy) on the island.
Until such time as this happens, US "moral superiority" over the Revolutionary Cuban government is rightly perceived as a lie.
Cubans deserve justice on this matter, but then again, this is just a pipe-dream.
Note: The judge said he could not grant "relief" to this murderous thug, but not because the charges brought against him were false, only because he was not in the "custody of Homeland Security"/INS.
Hypocrisy reigns supreme. I side with the Cuban government on this issue.

Is there a democratic Congressperson or Senator who thinks Posada should be sent for trial?

11. Article on Posada, from Brazil: The terrorist is knocking on the door
The terrorist is knocking on the door

Luis Posada Carriles, the man accused of knocking down a crowded airplane, exploding a hotel and trying to kill the Cuban President asks the US for exile. What now, Uncle Sam?

Déborah Moreira
He has been trained by the CIA to hunt down Fidel Castro. He wanted to kill the Cuban President and would support anyone else that agreed with him. For that, he is considered a hero by the Cuban dissidents that live in Miami. But this 77 years old man is also a notorious terrorist, responsible for attacks that have taken away the life of many innocent people. He now wants to join his old admirers. Luis Posada Carriles has illegally entered the US and is now asking for political exile.

The incident took place last Tuesday when the request was registered by an immigration service in Miami. It was too late to avoid the disturbance. Posada was already inside the country as an illegal immigrant. Hosting him means, to the US justice, to expose the country’s tolerance towards terrorism– as long as it is committed against the “enemies”. Sending him to another country also means doing a good deed to a terrorist. Sending him back to Cuba means to forsake a friend in, who has been trained by the American Secret Service, and abandon him in his old age. That is not a problem, since the concerned person is a terrorist. But delivering him to Cuba would put a great part of Miami against the Bush government.

Bonds with the Empire

Posada has been trained by the CIA to take part in the disastrous invasion of The Bay of Pigs in 1961 - when Cuban exiles against Fidel Castro had the support of the John Kennedy government and arrived in the island willing to take the Cuban leader out of power. Posada was part of the group in charge of the explosives.
