NBC: Janklow Guilty on all charges

FLANDREAU - A Moody County jury has convicted Rep. Bill Janklow of second-degree manslaughter in connection with the August traffic accident that killed a Minnesota motorcyclist.

The jury also found the congressman guilty of three misdemeanors, including reckless driving, speeding and running a stop sign.

The president's ability to pardon extends to all kinds of crimes. It makes no difference that this is a state crime. Most crimes are. The pardon authority is unfettered.

Nonetheless, I cannot see * being stupid enough to step in and do anything like that here.

The President shall be commander in chief of the Army and Navy of the United States, and of the militia of the several states, when called into the actual service of the United States; he may require the opinion, in writing, of the principal officer in each of the executive departments, upon any subject relating to the duties of their respective offices, and he shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.

Against the United States...not against an individual state.

testified that they let him get away from priors KNOWING his driving history. Had he lost his license a year ago, his victim would still be alive. It is one thing to show mercy to a driver with no significant past driving history..it is quite another to aid and abet a serial wreckless driver.

49. Attorneys: why would Janklow's lawyer ask for rapid sentencing?
Janklow's lawyer, Ed Evans, asked to be sentenced as soon as possible. The judge says he'll see if it can be compiled sooner if he can but wants to make sure it has all the information he wants.

a pre-sentence investigation.
There is, many say, skullduggery aplenty in Janklow's past.
Some of it, to be sure, he has hidden fairly well. It might be passed over if investigators don't have the time to poke around with it.

Even if it was a low maintenance dose of ultra-lente, which you would supplement by short-acting insulin immediately before a meal, you simply do not go for 18 hours w/out eating when you're on insulin. All the more ridiculously unlikely if he was taking some combination of NPH and R insulin, which is more common.

Know what an insulin reaction feels like? Like someone has just pulled your plug, your capacitors are rapidly draining, you're breaking out in a cold sweat and getting tunnel vision, and your body is screaming one single overwhelming and absolutely unignorable message: FEED ME NOW OR DIE.

This is not something you fuck around with or have questions about, if you've ever experienced it. You simply do NOT go for a whole day without eating. Trust me, I know.

manslaughter or second degree murder. The prosecutor was right: this guy was playing Russian Roulette with his driving, it was only a matter of time before he killed someone. I feel so sorry for Randy Scott's family. I hope the judge sentences him just like any other person.

62. AS A FORMER LAWYER WHO QUIT PRACTICING,...
,...this system is all we have,...and it does work towards justice albeit with many flaws and unintended and inequitable outcomes. My biggest complaint (and consequential exit entirely from that system) had to do with how money/influence proved an irreconcilable obstruct towards "justice". Apparently, even those "powers that be" can be overcome via the system we have,...from time to time. All we really have to do,...is improve that system,...tone out the money/influence card,,...and, perhaps,...we will have ourselves something more just and equitable.

80. A judge recently told me
and the other jurors on a rape, incest, child molestation, and sodomy case that bad as the case was, the absolute most difficult case to decide is vehicular homicide. He said that in his twenty plus years on the bench, vehicular homicide cases were the most contentious for jurors.

83. I would imagine that is because everyone can imagine being...
...involved in a serious automobile accident themselves. I could not imagine finding myself involved in a rape, incest, child molestation, or sodomy case. But a car accident? Yes, I could. I am driving every day.

70. Janklow to Resign Following Conviction
FLANDREAU, S.D. - Rep. Bill Janklow was convicted of manslaughter Monday for speeding through a stop sign and colliding with a motorcyclist. Janklow later announced that he will resign from Congress. I wish to inform you that because of present circumstances, I will be unable to perform the duties incumbent on me in representing the people of South Dakota as their U.S. representative," Janklow wrote in a letter that he said was to be sent to House Speaker Dennis Hastert on Tuesday.


"Therefore I wish to inform you that I will resign from the House of Representatives, effective January 20, 2004."


That is the same date Janklow is scheduled to be sentenced on his manslaughter conviction. He could get up to 10 years in prison.

81. Janklow's seat should go to the Democrats
With Herseth running, they have an excellent chance. She's leading any Republican except Thune (48-40 in the last poll, I believe). I actually think that she could beat Thune, since voters will be so sick of Republicans because of Janklow that they'll want a full party switch. With Herseth elected, she instantly becomes the future of Democratic politics in South Dakota and the frontrunner for the 2010 (I know it's a tremendous way off, but she will be the frontrunner) Senate race. Many said that Daschle would've retired or run for president if he wasn't so worried about losing his Senate seat. With Herseth in Congress, Democrats would have that heir apparent (interestingly enough, both Daschle and Johnson served in the House before the Senate).

92. i talked to a friend of mine who is politically active and he thought
janklow was a Dem. he made the assumption based on the media's constant attacks on Dems over the last 3 years.
