Libby Plans to Testify in CIA Leak Trial
WASHINGTON (AP) -- Vice President Dick Cheney's former chief of staff plans to take the stand at his upcoming trial to tell jurors that he never lied to investigators in the CIA leak case, defense attorneys said Friday.

I. Lewis "Scooter" Libby is charged with perjury, obstruction and lying to the FBI about his conversations in 2003 with reporters regarding Valerie Plame's CIA job.

Libby plans to testify about President Bush's daily terrorism briefings and other classified information to persuade jurors that he had more important things on his mind at the time and didn't remember his discussions with reporters, attorneys said in court papers filed Friday evening.

"Mr. Libby must be able to discuss classified information to give the jury an accurate picture of his state of mind during the relevant time period and to show the jury that any errors he made in his statements and testimony were the product of confusion, mistake and faulty memory rather than deliberate misrepresentations," defense attorneys wrote.

The documents were filed as part of Libby's bid to use classified information at his trial in January. Defense attorneys plan to use a digital slide show to present material to jurors, according to court papers.

mockumentary that shows exactly what happened to Libby? perhaps the fellow that produced the ABC/Disney Clinton-hate movie could help shoot it.

6. Maybe he could read some passages from his book.
He'll get top-notch coaching from testimony experts, maybe some neurolinguistic programming training, and he'll look and sound so innocent. The poor, dedicated civil servant, dealing with double-super-secret stuff to protect innocent Americans from a new kind of threat, never faced by our country before.

But Fitz already knows this, and will be ready.

We should keep in mind that Libby's attorneys had worked with Mr. Fitzgerald to find a plea deal, before Scooter was indicted. Because the plan included significant incarceration, Scooter rejected it. Still, it indicates that Team Libby is aware of the strength of Mr. Fitzgerald's case. They are preparing to have Libby take a mighty big gamble.

9. If this goes to trial,
and Scooter gets on the stand, he will be convicted on every count. More, federal appeals courts tend to be less likely to grant some types of appeals if a defendant testified in the trial in which he/she was convicted.

10. He has bravado because knows Walton may dismiss the case...
Check out this article that notes that Judge Reggie Walton and Libby's lawyers seem to be working out some effort to allow Walton to dismiss the case if Libby's lawyers can come up with "necessary" evidence that Libby would "need" for his defense that are too secret to be made public. Then Reggie "I love the State Secrets privilege" Walton, would dismiss the case, no matter what Fitzgerald wanted to do.

We need a whistleblower to come forward about this "evidence" that would be the excuse for dismissing the case to show that it's being dismissed for political and not true security reasons!!

11. This Is The Graymail Portion Of The Case
And unless Walton had ruled in this manner, the case could have been lost on appeal. Of course they want the case dropped, they really can't afford for the Libby Liar to go down. And a conviction in the criminal case will be very helpful to the civil one, which is really where we have a chance of having all the nasty bits coming out.

13. We should VALUE and NOT SETTLE/DISMISS any criminal case!
Civil cases are going to be dismissed with state secrets privilege rulings, etc. We can't count on them to go after these bastards. That is why the Libby criminal case is SO important. We won't get that many of those kind of cases happening. It might not be the end game for establishing what happened and who was responsible for Plame's outing, but it IS the only way we can get any progress towards finding out the truth of what happened there. We CANNOT allow them to dismiss this case!

14. No One Is Suggesting Any Such Dismissal
Except for the spin doctors who are also calling for a pardon. Time to worry is if Fitzgerald acceded to any such ludicrous suggestion. Judge Walton ruled rightly and as the law requires, stated for the record the options Fitzgerald has. As for the civil case, I for one anticipate greatly the spectre of Rove, Libby and Cheney being deposed.
