Restraining order to prevent attacks on Iran, Syria denied

CONCORD – A federal judge on Wednesday denied a former Republican congressional candidate’s request for a restraining order barring President George Bush or Vice President Richard Cheney from bombing Iran or Syria.

Mary Maxwell, 59, of 179 Loudon Rd, Apt. 10, Concord, filed a lawsuit Monday against Bush, Cheney and other “unnamed defendants actively engaging in acts of war against Iran and Syria in the guise of the war against terrorism.”

Maxwell’s suit seeks a ruling that the administration lacks legal authority to preemptively attack either Iran or Syria without a Congressional declaration of war, and that radioactive fallout from the use of nuclear weapons in any such attack would endanger people around the world, including herself.

Maxwell plans to appeal Barbadoro’s ruling, she said Wednesday, and she vowed to appeal her suit to the U.S. Supreme Court if she isn’t successful in the lower courts.

3. This is truly interesting
If she can keep this in the courts for a while, it could become a national debate on the fascists' usurpation of Congressional powers, not to mention the more obvious warmongering they engage in.

Logically, Iran has every right to not only nuclear technology, but the bomb as well. Why can Israel have it, illegally, and its enemies cannot? If the Repukes had shown the slightest tendency to stand down a bit, we might have a point. But our warmongering would make ME want the bomb, for sure.

7. It's a sad statement of our times when U.S. citizens feel they have
to resort to things like this to protect themselves from our own government. I heard Mary Matalin on Imus this morning flat out admit that Bush and Company are worried that they are liable for war crimes without changing the law.

Hmmm. Would the media ignore thousands of people filing suit? How about a class action suit against Little Boots and his gang? I am keenly interested.

What if a hundred or more members of Democratic Underground were to file a suit, collectively as a unit under the umbrella of Democratic Underground? I believe, theoretically, you cannot sue the government per se, maybe I'm wrong, but would this not put people on notice that the actions of the bush administration are clearly illegal?

Sure, I'm willing. I hate like hell paying taxes to support the war in Iraq, and war against Iran is just asking too much of the American people, and the world.

I recall a little passage about "only the Congress can declare war". Without taking that seriously, the president has more power than the king of England did in 1776.
