Hacking of Schwarzenegger's Computer Suspected ("hot" tape downloaded)
Hacking of governor's computer suspected
Published comments had been taped, stored on office server
Carla Marinucci, Tom Chorneau, Chronicle Political Writers
Monday, September 11, 2006

California Highway Patrol officials have opened a criminal investigation into "multiple" breaches and illegal downloads by outside hackers into the computers of Gov. Arnold Schwarzenegger's office, after an embarrassing private taped conversation was leaked last week to the Los Angeles Times, administration officials told The Chronicle.

"There is an investigation conducted by the California Highway Patrol on how the tape obtained by the L.A. Times was acquired," said a senior official who spoke on condition of anonymity. "This is a criminal matter that has been turned over to the CHP."

The governor was criticized last week after the Times reported that during a conversation in March with Susan Kennedy, his chief of staff, and Gary Delsohn, his speechwriter, Schwarzenegger referred to Latinos and African Americans -- specifically Republican Assemblywoman Bonnie Garcia, who is of Puerto Rican descent -- as having "hot" blood or a passionate temperament.

The Times reported that the conversation had been taped as part of Delsohn's occasional practice to capture the governor's speech patterns for his work....

According to a senior administration official who spoke Sunday with The Chronicle, a preliminary investigation showed that an outside individual or individuals had apparently hacked into the computer servers of Schwarzenegger's office and downloaded the tapes....

1. It criminal now, but ...
when the democratic senators in D.C. get their personal computer hacked, there is no investigation.
The hypocrisy is so thick.

2. Sounds Nixonian to me
Remember those Nixon tapes. The ones where Nixon really cut loose on Jews and Blacks. Arnie just pulled a Nixon and got caught. But because it's arnie we will have a full investigation of the hackers. Never mind what remarks were made.

4. Sounds like Karl Rove to me
Straight out of Mr. Rove playbook

<snip>
In October of 1986, Rove was working for Republican Bill Clements in his race against then-Gov. Mark White. A few days before the candidates were to debate, Rove discovered a listening device that had been planted behind a needlepoint picture of an elephant hanging on his wall. The FBI investigated. Accusations and counteraccusations were made. But no charges were ever brought, and the matter slowly dissipated, amid general speculation that Rove had planted the bug himself.

The B.S. meter is struck on eleven with this one.

He is what really happened, somebody had a moment of conscience about racism (which these comments are) and release it to the press. Nothing more, nothing less.

9. Don't those tapes belong to us anyway?
Someone should place a records request on all A/V tapes.
Do you have to be specific? In other words do we have to
know that the tapes exist to place a specific request?

15. They weren't hacked as much as they were entered without authorization
At issue was a computer system that allowed Republican staffers to read Democratic memos and correspondence without a password. Some of these staffers argued that they told the Democrats about the security breach in the summer of 2002. Others believe mum was the word before November 2003. In any case, the Republicans had more than a year of unfettered access to Democratic documents before this scandal became public.

Each time the Republicans accessed the Democrats' files without authorization, they at a minimum violated the federal Computer Fraud and Abuse Act, 18 USC Sec.1030(a)(2). That statute includes anyone who "intentionally accesses a computer without authorization or exceeds authorized access, and thereby obtains 3; information from any department or agency of the United States."

The Bush cabal doesn't do investigations, don't you know?

8. In California, the Highway Patrol and the State Police merged
about a decade ago. So, functions that would be covered by the SP in other states (such as dignitary protection and security at the Capitol and other state building) are done by the CHP. The reason for the merger was an attempt to streamline agencies and cut costs a bit...

10. Thx...
to both mrdmk and you...

I figured something like that...but I was curious. I am in Canada...so the local police/state police thing can be confusing...we have local police and our 'state police' is a federal thing; Mounties...except in Ontario.

14. I wondered why CHP too. I just looked it up and learned that because
the crime happened in a state/government building -- it's their jurisdiction.

16. Not that I support Arnie but who cares if he said someone had hot blood?
Or a passionate temperament, this country is getting too PC for me. I dont even see what the deal is. Are there any Puerto Ricans here that what he said would offend?

I would be very angry if someone said there was a "strain of Irish blood" that makes me like a glass of wine with dinner.

22. Perhaps we care because Arnie's a RACIST!
The Groppenfuhrer has a long history of racism, but it's been a hard charge to get in front of the media--especially when the media in CA just LUUUUURVES them some Terminator worship.

Have you seen Arnie's "Seig Heil" salute pose? Have you read any of his earlier interviews? This sort of racist crap is completely in character for him, but it's about as outside the media spotlight as Shrub's AWOL years in the TANG.

21. Gee, I wonder if this hacker story is just a cover for tracking down the
reporter's source for the story. The CHP investigates and finds out who had access (internally) and busts them for sharing the information and like a miracle, the hacker angle gets completely forgotten about. I wonder......
