Navy lawyer once posted at Cuba base is charged

NORFOLK - A Navy lawyer who was stationed at Guantanamo Bay has been charged with copying and sending secret information about detainees in U.S. custody to someone outside the government.

Lt. Cmdr. Matthew M. Diaz could face more than 36 years in prison if convicted of three violations of military law. Diaz, now based in Jacksonville, Fla., is tentatively scheduled for a preliminary hearing in October in Norfolk, said Beth Baker, a spokeswoman for the Navy's Mid-Atlantic Region.

According to the eight specific counts against him, which the Navy released Monday, Diaz deliberately made "a print out of classified secret information connected with the national defense" between Dec. 20, 2004, and Feb. 28, 2005.

Diaz is also charged with knowingly communicating information he was authorized to access - as well as information he had unauthorized possession of - "to a person not entitled to receive" it.

1. This reminds me of the Capt. James Yee case. What he had in his
computer was normal information for a prison chaplain (at Guantanamo)--info on location of prisoners, etc., but they trumped up charges against him of possessing and transporting classified info, and threatened treason charges. All B.S. They kept him in solitary confinement for months on these B.S. charges. When their case fell apart, they sought to embarrass him and revealed that there was porn on his computer, with his wife and family sitting in the courtroom. That was probably trumped up, too. (Who DOESN'T have porn in their computers these days? It pours in unsolicited!) They ruined his career and drove him out of the Air Force. His crime was that he was a Muslim--and that he cared for those in his charge.

Absolutely disgusting performance by the government!

It is heartbreaking and infuriating, the way the Bush junta is breaking military morale. They go after the best people--the good people, the ones who won't toady to their fascist agenda, and who have a code of ethics, and a sense of morality, or any humanitarian instinct, or loyalty to the Constitution and the UCMJ and the Geneva Conventions.

This bothers me more than ANYTHING--the breaking of peoples' spirits, the ripping apart of peoples' souls.

4. Hmm, "not entitled to receive it," sounds like the AIPAC case.
I'll wait until hearing more details about this particular case since I have no idea what the information supposedly was. The Yee case was a travesty because the original charge was over pretty damned thin stuff. The porn stuff, well, the British used that one against a suspect innocent of terrorism who they shot during a house raid involving 250 cops (big event a few months ago).

Having said that, I don't want to defend transferring info that there's a genuine reason to keep secret. I'm just wondering what the hell this info is and who the info was sent to... stuff on prisoner detentions to the ACLU? What? Guess we'll find out eventually.
