The Australian-raised Oscar winner was formally charged by the Los Angeles County District Attorney on Wednesday with three offences, including driving with a blood alcohol content over the legal limit of .08 per cent.

The penalty Gibson might have to pay for the anti-Jewish comments he is alleged to have made when arrested could be more severe than anything the justice system might dish out.

But Gibson, who partied with tourists into the early hours of last Friday at Malibu restaurant Moonshadows before being pulled over by a sheriff's deputy, faces a maximum sentence of six months in an LA County prison.

Two of LA's best criminal lawyers agreed it was unlikely Gibson would be jailed if convicted.
