Senate candidate asks General Assembly to impeach president

PROVIDENCE, R.I. (AP) -- Democratic Senate candidate Carl Sheeler is asking the General Assembly to start impeachment proceedings against President Bush.

Sheeler says the president lied about his reasons for wanting to go war in Iraq and wiretapping. He says Bush's administration also lied about what it knew about the levees breaking in New Orleans. Sheeler issued his call yesterday at the Statehouse. He says the General Assembly should send a joint resolution to Congress to start impeachment hearings.

1. What are the implications of a State Assy impeaching a President?
I am sure there are no legally binding rulings but WAY TO GO Rode Island!

A state legislature can initiate impeachment proceedings against the President (of the US) by transmitting charges to the US House in a joint resolution (the article cites Section 603 of the United States House Rules).

Presumably, it's a way of forcing the House to act on it, one way or another.

Yes, a state legislature can pass a resolution recommending impeachment. Its not clear that they can force a member of Congress to introduce that measure, but even if they can, the matter simplywill be referred to the Judiciary Committee in the same way that an impeachment resolution gets referred to Judiciary when introduced by an individual member of Congress. And until the Democrats control Congress, any impeachment matter sent to the House Judiciary Committee is going to disappear without any action. Happens all the time.

I don't dispute what you suggest is going to come of the effort, but what do you mean by 'Happens all the time'? When was the last time a state legislature recommended impeaching the president to the US House?

I don't remember it ever happening before. :shrug:

12. I should've been more clear
You're right that state adopted resolutions calling for impeachment of federal officials are quite rare. What I was referring to is the fact that most of the time, when resolutions for impeachment are introduced, they get referred to the Judiciary Committee where they disappear. Few people realize, I would imagine, that in recent years, impeachment resolutions were introduced in the House of Representatives with respect to Bush I, Ken Starr, and Donald Rumsfeld. All were sent to Judiciary where they sank without a trace. (There are a couple of other examples involving judges, but to the extent that my post could be read as suggesting that impeachment resolutions of any kind "happen all the time" I should've been clearer about that as well.

4. Thanks for posting this, katinmn! I was born in RI and it still holds a
special place in my heart. I sent a donation to Carl when I heard he had announced his candidacy a couple of weeks ago by calling for impeachment. He has taken another giant step with this speech. Go Carl!!!

7. This is good.
What I really would have liked to have seen was a number of states all doing this simultaneously, in order to make a stronger statement. Hopefully others will quickly join in.

16. Thanks Sheeler. Now if we could move
other blue state legislatures to also heed the call. I think that might be an avenue that the MSM could not ignore. Imagine several states sending their joint resolutions to congress on the same day. No way they could ignore it. What do you think? Can we lobby the states?
