Court Asks for Response to DeLay Motion (disputes DeLay spokesman)
AUSTIN, Texas - The state's highest criminal court has asked prosecutors to respond to former House Majority Leader Tom DeLay's request that the charges against him be dismissed.

The all-Republican appeals court on Tuesday gave prosecutors a week to submit arguments regarding the request filed Friday by DeLay attorney Dick DeGuerin. The court will decide whether to take the case after the prosecutors' response is received.

DeLay spokesman Kevin Madden issued a statement Tuesday night saying the court had agreed to hear the case. A court official said Wednesday that was incorrect. The court's order had noted DeLay has filed the request and "it is ordered that the State may respond to these pleadings no later than one week from the date of this order."

5. Even though that is better than being appointed, cause they have
to worry about political fall out before their next election cycle.

in other words: everyone is watching them and they know it- hence the Judges correction that is highlighted in this story. This does not look good for Delay at all - Rethuglians or not he is toast and he knows it.

Judges as a rule don't care much for seeing cases before them tried in the media, and the court official's comment that DeLay's spokesman was "incorrect" is a little spanking in public for those who watch those sorts of things.

I don't think it will have any bearing on the court's ruling on DeLay's motion, but DeLay is once again on notice not to send his mouthpieces out to mischaracterize what's going on. DeLay's attorney, DeGuerin, has been notably silent of late. Now the word needs to get out to DeLay's staff.

9. I thought prosecuters had already presented evidence hence the indictment
I guess in order to provide a speedy trial as guaranteed by the Constitution they will have to reiterate the charges and the evidence and let the court decide. I hope there is justice in Texas but their reputation indicates otherwise..:shrug:

10. this is for an "appeals" hearing not the original hearing or venue that
Delay was indicted for, I know it is a little confusing, but isn't the law always confusing???

11. Let the bastard wait for justice...
That pig DeLay -- no matter how dirty and vile -- deserves his day and court, and he should not be denied it. I strongly believe the evidence will reveal his wicked and twisted political soul to all the world. He knows that if this comes out a lot more will follow and he shall fall completely from Grace. Let the legal process take its course naturally -- hopefully by late February, early March at the least.

Justices agree to consider hearing DeLay's money laundering case

AUSTIN — Media reports that U.S. Rep. Tom DeLay had convinced the state's highest court to hear his appeal were as widely circulated as they were, well, wrong.

Justices for the Texas Court Criminal Appeals agreed merely to consider hearing DeLay's money laundering case. They never said they would accept the case, said Edward Marty, the court's general counsel.

The erroneous media reports, which the San Antonio Express-News published in a wire story and displayed online, come from DeLay's spokesman, Kevin Madden, in an e-mail sent to reporters Tuesday evening, after courts had closed for the night.

“FYI-Breaking news out of Austin, TX,” the e-mail stated. “The state Court of Criminal Appeals has agreed to hear Mr. DeLay's habeas motion that was filed at the end of last week. The court has set a one-week deadline for briefs to be filed by the parties involved. The court could essentially decide to end Ronnie Earle's prosecution after hearing this motion and the facts presented.”

Madden said this afternoon that he made an error and never intended to “spin” the story.

WASHINGTON, D.C. - The Department of Justice announced today that Kevin Madden has been appointed Deputy Director and Press Secretary in the Office of Public Affairs.

Madden served as a spokesman for the Bush-Cheney ’04 campaign from September 2003 to November 2004, where he designed and implemented a strategic communications plan for a 17-state region that included Ohio, Pennsylvania, and New Hampshire. From 2001 to 2003, he served as communications director and a senior advisor to Rep. John Sweeney, and from January 2001 to March 2001 he was a public relations associate at the firm of Craig Shirley and Associates. Madden was the Washington representative for the Yonkers Industrial Development Agency from January 2000 to September 2000, where he promoted the city’s funding and regulatory interests by working closely with congressional and other federal government offices. From 1997 to 1999, he served as the primary spokesman for the Office of the Mayor of Yonkers, and from 1994 to 1997 he served as the communications director for the Office of the Yonkers City Council President.

Madden holds a degree in communications from the State University of New York, Cortland.
