Senators say Alito respects Roe decision

WASHINGTON - Supreme Court nominee Samuel Alito said the court's landmark Roe v. Wade decision deserves "great respect" but did not commit to upholding it in the future, senators said Tuesday.

Sen. Joseph Lieberman, D-Conn., said Alito told him the 1973 Roe v. Wade decision establishing abortion rights "was precedent on which people, a lot of people, relied, and had been precedent now for decades and therefore deserved great respect."

Lieberman called that "encouraging," but also said the federal judge had not assured him that he would not overturn Roe.

8. Blacks were 3/5 people for years of precedent and lot of people
relied on that, along with not allowing the little woman to vote.

Precendent's change over time, in those cases for the better - but someone simply saying that something has lasted that way a long time does not mean they wouldn't change it.

Lieberman is only worthwhile to the Democrats because he brings us one vote closer to a majority. Still, if that vote were necessary for us to gain the majority I'd bet dollars to donuts he'd make it official and become a Republican.

Plessy V Ferguson was precedent and was deserving of great respect until it was overruled in the cases leading up to, and in Brown v Board of Education.
Too bad he just won't say what he's gonna do, and we vote on the reality rather than on the tea leaf reading.

Supreme Court nominee Samuel A. Alito Jr. has signaled he would be highly reluctant to overturn long-standing precedents such as the 1973 Roe v. Wade abortion rights ruling, a move that has helped to silence some of his critics and may resolve a key problem early in the Senate confirmation process, several senators said yesterday.

In private meetings with senators who support abortion rights, Alito has said the Supreme Court should be quite wary of reversing decisions that have been repeatedly upheld, according to the senators who said it was clear that the context was abortion.

"He basically said . . . that Roe was precedent on which people -- a lot of people -- relied, and been precedent now for decades and therefore deserved great respect," Sen. Joseph I. Lieberman (D-Conn.) told reporters after meeting with Alito yesterday. Sen. Susan Collins (R-Maine) said she had a similar conversation about an hour later with Alito, who has made clear that he personally opposes abortion.

"I asked him whether it made a difference to him if he disagreed with the initial decision but it had been reaffirmed several times since then," Collins told reporters. "I was obviously referring to Roe in that question. He assured me that he has tremendous respect for precedent and that his approach is to not overturn cases due to a disagreement with how they were originally decided."

I'm glad to hear this position, but if this story sticks, won't this only make the fundies slam him down?

They are soooo incensed over getting this done, if they get a sniff of him not carrying out thier dream, they'll mount their attack all over again!

38. i tend to agree with Lieberman.
I don't see Roe v. Wade being overturned. There isn't enough momentum on the court, even with Alito present to hear the case again to overturn it. Even Scalia wouldn't take on Roe v. Wade, he's said so himself, I don't think we have to fear that from Alito.

There are however, more important things to fear from Alito regarding his pant-soiling love of the business community, that we should be opposing him for.
