DeLay Case Likely to Remain in Travis County TX

(AXcess News) Austin TX - Prosecution witnesses in the DeLay hearing for a motion to move the powerful Texas politician's case out of Travis County gave testimony Monday citing reasons why they believed Rep. Tom DeLay would receive a fair trial there. DeLay's attorneys argued that Delay, who is facing money laundering and conspiracy charges in Travis County, would be prejudiced by the court in that jurisdiction and want the trial moved.

Travis County is at the heart of the complaint after the county was split into three different congressional districts as a result of a redistricting map DeLay engineered. The prosecution has said that much of the funding to political campaigns there were manipulated to appear as if they were legitimate by moving the cash into and out of Washington DC first. DeLay's attorneys have argued that the defendant would be "vilified" if the trail were held there.

Previously, DeLay's attorneys tried to oust the judge handling the case. Pat Priest, a semi retired San Antonio Judge was assigned to the case last week. Priest's first order of business will be the motion Delay's attorneys filed to move the case out of Travis County.

Dick DeGuerin said state law mandates this type of case be returned to the home county of the accused. That would put the trial in Fort Bend County, outside of Houston. DeGuerin is DeLay's lawyer in the money laundering and conspiracy case.

he may do even worse in Fort Bend County.

Actually, DeGuerin is wrong. These trials are always held in Travis County.

As Tom Delay awoke one morning from uneasy dreams he found himself transformed in his bed into a gigantic insect. He was lying on his hard, as it were armor-plated, back and when he lifted his head a little he could see his domelike brown belly divided into stiff arched segments

Prosecutors argue for DeLay trial in Austin
State wants case to be heard in Travis County

AUSTIN, Texas (AP) -- Travis County is not so prejudiced against Rep. Tom DeLay that former House majority leader couldn't get a fair trial in the city, a veteran defense attorney said Monday in a sworn court statement.

The affidavit by Betty Blackwell was filed on behalf of prosecutors who are arguing against DeLay's request that his trial on money laundering and conspiracy charges be moved to another county.

"There is not so great a prejudice against the defendant, nor is there a dangerous combination of any sort, that will interfere with him receiving a fair trial in Travis County," Blackwell stated in the affidavit.

The change of venue request probably will be the first order of business for semiretired San Antonio Judge Pat Priest, who was assigned to the case last week.
