DeLay Asks That Indictments Be Set Aside
This is scary. Hope it's B.S.

DeLay's attorney, Dick DeGuerin, alleged in a court motion that Travis County District Attorney Ronnie Earle unlawfully participated in grand jury deliberations when he went to a second grand jury last week to seek a second indictment against the congressman.

DeGuerin also alleged that Earle "attempted to browbeat and coerce" the second grand jury to change its decision not to indict DeLay so there would be no public record of a rejection


This is the part that worries me...

Two people familiar with the proceedings of the grand jury that "no-billed" DeLay said that Earle tried to persuade the grand jurors that DeLay tacitly approved the scheme and that the prosecutor became angry when they decided against an indictment. The people familiar with the proceeding insisted on anonymity because of grand jury secrecy.

This -seems- to say they "no-billed" him (which means no indictment)...is whoever wrote this claiming Earle persuaded them to change it? (Yes, I see it says "tried...) It doesn't make any sense to me. :eyes:

11. The thing that angers me is that we know that DeLay is guilty of much
worse than campaign finance shenanigans and money laundering, though we know he's guilty of that, for sure. He's guilty of sanctioning sweatshops using slave labor in Saipan. But if this is all we can get him on, so be it. But it's like getting Al Capone on tax evasion... And if he's guilty of all this, we know for sure that he's capable of pretty much anything, and certainly not above lying or doing anything he possibly can to make this go away.:grr:

On edit: I am seeing that DeLay filled a motion to have the investigation quashed. CNN has nothing says he is filing a wrongful prosecution suit.

There actually has to be a prosecution first. There hasn't been one. An indictment is not a prosecution.

oh my, this is soooo funny. I suspect that mr. rodent/cockroach demanded that his attorneys do so, despite their best advice, and they complied. I wanna see the releases and agreements he signed with his lawyers BEFORE they took this step.

Of course, Texas law is different from most parts of the country, with only Luey-siana as even stranger. So, ignorance is somewhat bliss.

If you are not guilty it does not matter. The prosecutors are protected and the county prosecutors don't have to pay a time for your legal fees incurred. Nothing like living in a res state.

Ronnie Earle's side of it for long.

You notice, in all of this, that the bug man doesn't want to face the actual CHARGES against him, because he knows they're absolutely true. So he & DeGuerlin are going to do their damndest to make sure Delay gets off on a technicality....SOMEWHERE!! They'll be shopping technicalities until they find a right wing judge who will rule in their favor.

All of the points above are valid, plus most states recognize virtually absolute immunity for public prosecutors. I doubt the story is true, but if it is it was a moronic thing for DeLay to do.

45. I wish Texas had a SLAPP-type law.

Then DeLay would get a few extra years for this crap.

But I suppose it's really a sign that he sees he stands to lose everything in high probability anyway, a contempt of court ruling or whatever he gets if this slamming the roulette table fails is probably small compared to what he gets when all the Abramoff and TRMPAC stuff (and whatever else pops up) hits the fan.

Earle is going to have to fight to take this guy's scalp. No surprise there. But the day he does it's gonna be worth it.

WASHINGTON, Oct. 7 - Defense lawyers for Representative Tom DeLay asked a court to dismiss the indictments against him on Friday, claiming that the prosecutor in the Texas case had taken "extraordinarily irregular" steps in trying to bring charges against the former House majority leader.

The two-page motion, filed just before the close of business in district court in Travis County, asserted that Ronnie Earle, the district attorney, had "attempted to browbeat and coerce" jurors into bringing a second indictment against Mr. DeLay after the validity of an earlier indictment was called into question. The motion accused him of prosecutorial misconduct.

"It's one of those things that really needs to be seriously investigated," said Bill White, an Austin lawyer who is participating in Mr. DeLay's defense. "In all fairness, it doesn't sound good, but let's air it out, let's see how serious it is and what's really there. It's certainly confusing."
