LONDON - Three British soldiers will be tried in a military court in Britain on the war crimes charge of abusing prisoners in Iraq, including one who died, Attorney General Lord Goldsmith said on Tuesday.

The three are among 11 British servicemen who face a range of charges in two separate cases arising from alleged abuses in Iraq in the months after the US-led invasion on March 20, 2003.

Although charged under the International Criminal Court Act of 2001, the servicemen will face court martial in Britain rather than being tried at The Hague.

One of the soldiers, Corporal Donald Payne, will also face manslaughter charges over the death of prisoner Baha Da’oud Salim Musa, according to the office of the attorney general.

4. Yes, bu the point is that the home country always tries people if possible
People are only sent for trail at The Hague if the home country is unwilling or unable to try them. This is saying that they will be tried in the UK.
