High court pick to have 'mainstream' values - Bush


WASHINGTON (Reuters) - President Bush pledged on Saturday to pick someone with "mainstream" values to serve on the U.S. Supreme Court and urged a fair and dignified confirmation process for his eventual nominee.

The list of people Bush is considering to replace retiring Justice Sandra Day O'Connor is being closely held by the White House. Aides say Bush is likely to announce a decision later this month.

"My nominee will be a fair-minded individual who represents the mainstream of American law and American values," Bush said in his weekly radio address.

"The nominee will meet the highest standards of intellect, character and ability and will pledge to faithfully interpret the Constitution and laws of our country," he added.

but anything other than that is fair game..

I thought they couldn't do worse than Crisco Boy for head Legal, but now, to install someone that obviously HATES HUMANS on a basica level - not main stream enough for me..

I'm ready to start calling him "Gonzales THE IMPALER" (like good old VLAD that the vampire stories sprang from)..

Only this guy eats tacos while people writhe in pain...Caviar Tacos..

I hate these people with a passion, and wish only their own mindset be used against them by their own followers.

12. I'm still embarrassed.....
That I supported Clarence Thomas during his confirmation hearings.

I was wet behind the ears politically then, and all I saw was a black man trying to be elevated to the Supreme Court, and I supported him.

Now, I understand that just because someone looks like me, and has my same skin color, doesn't necessarily mean that they represent my interests or represent my values!

Take Janice Rogers Brown, or Condeleza Rice (when she was nominated for Sec State). African American women

It would be like Clarence Thomas all over again. Many who don't pay that much attention to politics or qualifications believe the spin. They applaud Dubya for his diversity and don't understand why Democrats are blocking her, only that they are trying to keep the blacks down.

The truth is, at least in the case of Brown and Thomas they are enemies of civil rights. For example, in Aguilar vs. Avis Rent-A-Car Systems (1999), Brown argued that free speech protections include allowing ethnic slurs in the workplace (and that such behavior does not constitute discrimination for "hostile environment"). As for Clarence Thomas, he was the only person on the Supreme Court who didn't think Thomas Miller-El deserved a new trial, even though the Dallas prosecutors who convicted him worked off of a manual with the following guidelines for jury selection, "Do not take Jews, Negroes, Dagos, Mexicans or a member of any minority race on a jury, no matter how rich or well educated."

As for Alberto Gonzalez, I do not feel he is hostile to minorities, but his record on civil liberties should cause all freedom loving Americans to tremble. If he could so easily dismiss the Geneva Convention, and so narrowly define torture, how would he interpret due process and cruel and unusual punishment? But, I bet a lot of Senators confirmed Gonzalez because they had significant Hispanic populations in their state & feared losing a major constituency if they did confirm. A profile in pragmaticism rather than courage.

We need to do a better job of getting our message out. We need people who are members of the minority to speak out against these people. When Whites do it, we just get labeled as racist, but in a way, it is reverse racism to like a candidate or nominee just because he/she is African American or Hispanic.

And I agree with you 100%

The Democratic Party has to do a much better job of really getting its message out, and explaining things.

It is unfortunate, but many Americans get their news and information in 30-second soundbites, and that's not long enough to really explain an issue to someone.

We need to start explaining, in detail, WHY we oppose these nominees, and what makes them so outside the mainstream of American jurisprudence.

Weren't "strict constructionists" in the court responsible for giving us the Dred Scott decision?

This is the first appearance in American constitutional law of the concept of "substantive due process," as opposed to procedural due process.

Dred Scott was not free, because Missouri law alone applied after he returned there.

The Court also presented a parade of horribles, describing the feared results of granting Mr. Scott's petition: "It would give to persons of the negro race, ... the right to enter every other State whenever they pleased, ... the full liberty of speech in public and in private upon all subjects upon which its own citizens might speak; to hold public meetings upon political affairs, and to keep and carry arms wherever they went." Scott was not a citizen of Missouri, and the federal courts therefore lacked jurisdiction to hear the dispute.
