BREAKING: Kobe Bryant Will NOT Waive Preliminary Hearing
Just announced on CBS Radio News. Hearing will occur later this afternoon.

Preliminary Hearing Begins in Bryant Case

EAGLE, Colo. - In a surprising move, Kobe Bryant's lawyers went ahead with a preliminary hearing Thursday to determine whether the NBA superstar should stand trial for rape.

Prosecutors were expected to outline evidence they say proves Bryant sexually assaulted a 19-year-old female employee at a resort June 30.

Legal experts had expected the defense to waive the hearing and head straight to trial rather than allow prosecutors to lay out their case publicly for the first time.

The judge had already rejected defense requests to have the woman testify in person and to see her medical records.

5. Other than bad publicity
there is nothing that he stands to lose by having the prosecution lay out its case. The defense may learn something new. And the prosecution witnesses that actually testify (I wasn't aware that a complaining witness could refuse to testify) will have one more statement under oath that may be inconsistent.
