SEC Seeking Documents from Former Enron CEO
WASHINGTON (Reuters) - The Securities and Exchange Commission on Monday sought a court order to force former Enron Corp. Chief Executive Kenneth Lay to produce documents in the SEC's investigation into the bankrupt energy trader.

The SEC alleged that Lay was withholding documents, which appeared to be related to corporate records. It said Lay has refused to produce them under an SEC subpoena on the grounds that by doing so would violate his Fifth Amendment rights.

snip..........

In a subpoena enforcement action filed in a federal court in Washington against Lay, the SEC alleged that Lay was chairman and CEO when "fraudulent activities" were carried out by Enron and its employees.

"The commission's investigation includes whether Lay had knowledge of, or was involved in, fraudulent activities at Enron," the SEC said in a statement.

1. I'ts coming from all sides now
Bring all those crooked BFEE guys down at the same time....

Woooo Hoooo!

Sorry, I had to indulge in some optimism that is seriously overblown. Of course this request will go un-fulfilled and Lay will continue swilling martinis at his vacation homes.

5. Interesting that the SEC is making this request, rather than the
Justice Department, which has supposedly been investigating Enron for the last two fucking years. If there was ever proof needed of corruption, conspiracy, and collusion to obstruct justice (a federal felony-class crime), the Enron investigation (and Enron's ties to the White house) is it. Apparently, there are so many Republicans and Dems guilty of "doing business" with Enron, few in the Congress have been screaming about the Justice Department dragging their feet on the Enron investigation.

It's all tied together: The stolen election in Florida; Enron's ripoff of California; Cheney's energy group meetings; FERC's refusal to stop Enron (and other Bush "buddies") from robbing CA for billions; The war in Iraq (oil ,oil, oil for Bush & Cheney's friends!); and the upcoming stolen election on California. No tin-foil hat needed on this one, the proof is there, but the White House, like Ken Lay, is "taking the 5th", and fighting all releases of evidence. What a stinking mess, and why isn't the press screaming about it???? Oh, I forgot, ...the same reason they didn't scream when Bush used lies to start his phony war; the media aren't just whores, they are part of the whole fascist scam too!

7. Asserting the 5th with respect to business records is dicey.
It basically implies that you were running a criminal enterprise.

10. Sadly, a lot of idiots do seem to be
putting money back into the Ponzi scheme sometimes referred to as the "stock market." I can only conclude that "stock" refers to domestic animals like cattle & sheep, being led off to be milked, shorn and slaughtered.

9. Lay has been ignoring the subpoenas for a year
and the SEC hasn't been pushing him.

NOW they are, because when we see the Tyco execs go to court, everyone is saying,"Why isn't that Ken Lay who goes first?"

Public opinion finally got to them...but justice DELAYed is justice denied. Maybe they thought we would just commend them for their action and FORGET that they have been plunking their butts on this for a year!!

BUT I DO NOT FORGET.
