This motion to dismiss may be part of a settlement. The fact that the DU side has not said anything suggests a deal may either be in place or is being negotiated now.

If there is a deal, confidentiality may be a requirement, in which case each side would likely soon issue a statement to which the other had agreed, or they might agree to say nothing at all except "case is dismissed."

This could be over and probably is, and we may never know how it went down. But make no mistake about it. DU won.
