My SO reminded me of that about 90 minutes after I posted this. And you're right. Here, the person you are legally bonded to is referred to as your "spouse" regardless of gender and it's specifically defined as "the person you are married to or legally partnered with or live with as if you are married". The only legal difference between marriage and domestic partnership (the same-sex equivelent) here is the very, very technical legalities (like what precisely defines consumation).
