First and foremost, he would have to convince the judge that he had made every reasonable attempt to pay the loans, and that it is (and will remain) impossible for him to do so. He must also show that the loan payments constitute an unreasonable financial burden. The standards for achieving this are evidently pretty tough. If he is capable of working at all, it's unlikely he would be able to make the case.
